The point is that ASADA stated in its report that it came from El Paso, Mexico.
The point was, according to BF, that the players were caused "mental stress" by being told it was from Mexico, where there have been claims that it was sourced from New Mexico, which would have made the players feel better.

It was from Mexico.

ASADA Comment (page 163): Dr De Morton recalled a further conversation with Dank which was in regards to ‘a thing called Thymomodulin, however, no follow up occurred from Dank in terms of providing any information: ‘I think again at the footie club, probably the sidelines – [Mr Dank said] “I’m thinking I’d like to use Thymomodulin” or something like that.’

BF's Comment: • This is circumstantial evidence that Dank intended using Thymomodulin;
Well using your own logic, circumstantial = weak right?
 
ASADA Comment: Despite players having been repeatedly injected with AOD-9604 and Thymosin, ASADA has been unable to recover any purchase orders, invoices or remittance notices from Essendon in respect of these supplements.
Even stranger than the above, they have also not been able to find any purchase orders, invoices or remittance notices for any legal substances either.

I still cant understand why the obviously completely honest Essendon Football Club has no receipts for goods that are totally legal and not banned, surprising for such a successful, well run club to err where the tax department is concerned, not one receipt for all that good thymosin(which we are assured by both GG and Bruce is a generic name for all products of the thymus gland)?

It must have been the minute where you sit there scratching your head at what was being put forward by the two fools, and having to re -read it to make sure that is exactly what was written.
I dunno, I think Bruce Francis may end up being a pretty good comedian. This report is an excellent joke.
 
(Page 184): Although Alavi was engaged to supply peptides for the Medical Rejuvenation Clinic and Best Buy Supplements (Sydney based companies in which Dank had a business interest), from Charter’s perspective, the raw materials he obtained from China were at the behest of Dank and were intended to fulfil Dank’s order.

BF's Comment:
• It is unconscionable for ASADA to offer as evidence “from Charter’s perspective”. ASADA didn’t even require Charter to quote from an alleged conversation.
• The fact that ASADA has not produced a single piece of paper proving Dank ordered anything notwithstanding, ASADA has no evidence that Dank was ordering for Essendon and not the Medical Rejuvenation Clinic and Best Buy Supplements.

Today, Fairfax Media published comments that Essendon lawyer Tony Hargreaves made on Thursday and which challenged earlier reports that some players had been given an unknown supplement sourced in Mexico from a man with a muscle wasting disease.

Mr Hargreaves said he had made his Thursday comments after he had spoken to the patient in question and had been told that supplements were sourced from a neurosurgeon in the United States.
But this afternoon, Mr Hargreaves said he had received fresh information today.
"The information I based the request for a retraction on was based on a conversation I had [with a party closely involved in this matter] on Thursday. Since that time, further information has arrived that cast some doubt on whether what I was told was accurate.’’
Fairfax Media has confirmed that evidence gathered by investigators and referred to in the AFL-ASADA report states that the patient told ASADA that he had purchased supplements in both Mexico and over the border.
The evidence gathered to date also confirms that some players were given supplements suspected to have been sourced from Mexico.
A source closely involved in the drugs scandal today questioned why Essendon had sought to publicly challenge the original story rather than confront the real issue it raised: the fact that players had been given a supplement whose contents was, and remains, unknown.
The shifting claims about the provenance of the drugs also highlights the way that much of the information surrounding the scandal is heavily contested.

The crux of the matter is that it doesn't matter. Unknown substances anywhere near the players represents major problems at Essendon. It's a perfect example of bad governance. Wait a minute.... Isn't that what EFC got done for? And on the back of this report?
 
• Charter never saw the substances so he can’t throw any light on what was delivered to Alavi on 28 December 2011.
• Charter can’t throw any light on whether Thymosin Beta-4 was delivered to Essendon
• Charter can’t throw any light on whether any Essendon players were administered Thymosin Beta-4.
• There is no evidence of Dank ordering anything from Charter
• There is no evidence of Charter delivering any substance to Dank or Essendon
• There is no evidence of Charter invoicing Dank
• There is no evidence of either Dank or Essendon paying Charter.
• As the veracity of a lot of the useless information Charter provided is non-existent, or very questionable, it’s incomprehensible why ASADA relied upon him as a witness.

Yes.

Poor governance is one thing, evidence that all 34 players used TB4 is another matter again.
 
Re the French case, the CAS Appeal Panel found:

1. In relation to the standard of proof required for a finding of guilt. That pursuant to the Australian authority of Briginshaw v. Briginshaw and CAS jurisprudence, the standard of proof required to be met by the Respondents is somewhere between the balance of probabilities and beyond a reasonable doubt...

2. In relation to charges that he had used trafficked in prohibited substances, corticosteroid (allegedly contained in a supplement preparation called Testicomp) and equine growth hormone (eGH): The CAS found that there was no scientific evidence that the Testicomp French had admitted to using contained a prohibited substance; and insufficient evidence "to conclude to the necessary degree of satisfaction that the knowing use of eGH has been proven."

3. Two major problems with the case against French: The allegation that French used corticosteroids by injecting Testicomp failed because there was no scientific evidence that Testicomp contains corticosteroid. Testicomp is a homeopathic supplement, which is claimed on its accompanying literature to contain corticosteroid, but analysis of Testicomp failed to find corticosteroids in the product. “An admission to use of Testicomp does not amount to an admission that there had been use of a prohibited substance unless the product used is shown by chemical analysis to contain that which it purports to contain by its product leaflet," the CAS Panel said.

4. In relation to use and trafficking in eGH: The CAS Panel found problems with what would in a criminal case be termed the chain of custody of the waste bucket found in French's room...
 
So why didn't Bruce write a report based on current evidence and not an 18 month old interim report?

As the PA said on seeing the summary of evidence: it's the same old stuff.

We know the witness list: five in total, three are refusing to appear and have not provided sworn statements, none have direct knowledge of EFC's supplements program.

It might be worth looking up what "interim" means.. certainly doesn't mean "final".

At least there is now a general acceptance that in terms of what ASADA had as at August 2013 (having interviewed over 50 witnesses and collected thousands of documents from the AFL) that that was sufficient to demonstrate to the comfortable satisfaction of the tribunal that TB4 had been used by 34 EFC footballers.

For the moment, it appears to be an article of faith that something additional of substance has been collected that will make the difference.
