    Where does it say he refused a breath test? He was charged with exceed 0.08 according to that document meaning he provided a sample. If he refused he would be charged with Failing to provide a sample (not sure of exact charge wording)which carrys the same penalty as DUI which is excess 0.15 in WA

    My only question is what else could Fyfe have been trying to do about from elbowing him in the head? I think they've got it exactly right however they are so inconsistent with how they grade things can see him getting this downgraded to careless.
