Sick leave entitlements

Does anyone know what the minimum sick leave entitlements are in Victoria? I'm totally confused, because I have been looking into it and there seems to be 3 answers being thrown up:

1) 10 days for most employees Source 1 , Source 2
2) 8 days per year or 1 day for every 6 weeks worked - Source
3) 5 days per year Source


So does anyone know what the actual rules are?
 
Taking some sick days seeing as most of your annual gets eaten up over Christmas? ;)

No, my old man has terminal cancer and I need to occasionally take time off work to take him to hospital and other such things. He's so juiced up on painkillers that he couldn't make his own way there.

Sick leave & carers leave fall under the same category, so I just asked about sick leave in general.

Carers leave is a lot longer than sick. I think as a general rule it's about 2 weeks of carers leave on top of the sick leave.

Call your boss and ask him/her.

I think you're referring to unpaid carers leave. As far as I know paid carers leave falls under the sick leave umbrella.

The problem is that the boss has allocated us 5 days sick leave p.a. But i've always been under the impression its 10 days minimum, and everyone i've spoken to thinks the same.

I've never brought it up with the boss before because I rarely take sickies anyway, never went over my 5 day p.a. quota. Obviously my situation has changed now, but I'm not sure if I'm legally entitled to 10 days or 5?

Just take the plunge and have a decent talk with your boss about your situation. If he's got any decency, he'll know that your family is going through a difficult time and will work with you to achieve a compromise that suits both parties if you need to take any extra leave outside your entitlements. Good luck and sorry to hear about your old man. That sucks.
 
Im not 100% sure but I thought it was 5 days in the first year and maybe 10 for every year after that and it its accumulated so if you havent taken the full amount you should have heaps. You get 2 days per year sick leave without a medical certificate and the rest you need to provide proof. Use as many as you can coz if you leave the job they aren't worth anything. Check with Industrial Relations they can tell you exactly.
 
It varies with whom you work for and what they fall under. Federal Award, Victorian Award or what your Work Place Agreement is.

Where I work, I get 20 per year, and if I take a single sick day and it isn't before/after a public holiday, I don't need a certificate :thumbsu:
 
it really depends on the employer and the union agreement in your work place l know l get 8 sick days and there are family care days as well l think total of 12 days..........................there's one employer that has unlimited sick days
 
Don't talk to your boss until you've spoken til your union. That way if he goes you're entitled to 5 days of paid carers leave, you can turn around and say well according to the union it's 10 days or whatever the case may be.

I get 10 days a year (I think I've got about 10 weeks of sick leave up my sleeve). We only need a medical certificate for 3 days in a row. Even then nobody ever asks for one, even if you are off longer than that. I know I never bother asking my team for one. Would only do it if I didn't trust them. Its so easy to get them anyway, it doesnt prove anything.

It depends on the boss, and your agreement/award. My old man was in the same situation with my mum last year. When she was at her worst he was given 1 week fully paid carer's leave and took 1 week annual leave as well. She was regularly needing to be taken to hospital and his boss would only record every second day off, and would tell dad to leave early and so on.

Explain your situation to your boss, it's a tough situation to be in, I'm sure he/she will understand and you can come to some sort of agreement regardless of the amount of leave you have accumulated. Sorry to hear about your old man too.

Depends on your contract but I am in a similar situation and I have been granted Compassionate Leave. I work for a fairly small company and have been here for over 5 years and I havent taken a lot of time off so they are being very good with my situation.

I get 10 days, same conditions with regards to certificates, but my leave also accumulates, so I have about 30 days up my sleeve in case of emergency

Im in a smiliar situation. I get 10 or 12 days per year allowed to me I believe, and have used one in total over the last 3 years since it started accumulating. :thumbsu: Its a pity that it doesnt get paid out when you leave. :thumbsd: The other pity is, my boss likes being really difficult and requires us to have a sick certificate for more than one day (and even if we do have one, he stills knows more than the doctor and says that we should be working), and the only days I want to have off are usually when sports events are on....and he is well aware of when they are. :(
