A man convicted of drowning his fiancee in the bathtub of their Adelaide home has been freed on bail after an appeal court granted him a retrial.

Henry Victor Keogh was jailed for at least 25 years after being convicted of murdering Anna-Jane Cheney in March 1994.

In the Supreme Court on Monday, Justice John Sulan said Keogh should be released on bail in light of an appeal court's decision to grant him a retrial. The Court of Criminal Appeal ruled on Friday that Keogh should be granted a retrial, saying there had been a substantial miscarriage of justice.

A forensic pathologist who conducted Ms Cheney's autopsy had recanted on aspects of the evidence he provided at Keogh's trial, the court heard.

Prosecutors did not oppose the granting of bail, which will see Keogh home for Christmas for the first time in 20 years.
 
I remember this. Gained a lot of media attention at the time. Reported he started up life insurance policies beforehand, hence why its alleged the pathologist stitched him up (get what they thought was a correct result)

Does he get those payouts now? DPP won't re try him.

On another tangent. Her death has been recorded as a domestic violence statistic organizations like white ribbon foundation use, will the records be amended?

The same pathologist has been involved in another high profile case with another likely innocent man jailed...

David Szach: denying a dying man

“Bureaucratic madness” is denying a dying man his legal rights to an appeal to clear his name of a murder conviction.

On 19 December 2014, it will be 35 years since the day David Szach received the then mandatory life sentence for murdering his lover, 44-year-old Adelaide criminal lawyer Derrance Stevenson. It is a crime which he vehemently denies.

He is now 54 and dying slowly from the effects of motor neurone disease – made world famous by Stephen Hawking. Before Szach slides into the abyss of this horrible disease, he wants his 1979 murder conviction officially quashed. After almost 14 years in prison (and attempts at appeal) he was released…but when he applied for legal aid to mount a further appeal under South Australia’s new legislation passed in 2013, he was refused.


A 1992 report profoundly discredited Dr Colin Manock’s forensic evidence which was used to help convince the jury of Szach’s guilt. Dr Manock’s evidence about the time of death was critical; Stevenson had been shot in the head and his body placed in a freezer. Dr Manock claimed certainty about the time of death; this was later discredited as an “invalid” conclusion.

The following year, 1993, Szach was discharged from prison (“kicked out of jail,” as he puts it, “without any pre-release program or assistance”) but he is still waiting for his name to be officially cleared, his conviction overturned. “I didn’t want to apply for parole,” he says continuing to adamantly protest his innocence, “because I should never have been before a sentencing court in the first place.”

The case against Szach is entirely circumstantial. Indeed, “The opinion of the trial judge seems to have been that the full story about the death of Mr Stevenson had not emerged,” noted the forensic psychiatrist W. E. Lucas in his 1988 report, after examining Szach.

All a bit bizzare really ...

Szach adds an alarming footnote: “The Commission’s director withheld Mrs Shea’s evidence from the police for about 10 weeks… on basis of legal privilege which actually hadn’t existed over that conversation. I have often wondered what if the director had provided that information to the police on the Tuesday – before I was arrested …”

Who was being protected by withholding this info you may ask?

Trial judge? What are your thoughts?
 
Maybe they thought Ms Shea was lying, thats why they held it back. Perhaps she had relationship of some sort with the accused?

I've seen individuals with power in courts hold vendettas against those they've wronged, last decades.

However examining the dead guys life is the most promising lead. Was really a sex offender when you think about it. Sometimes their victims strike back. With the history of the family killings, they must make them toss and turn at night.

There is some link with that Stevenson guy to the 'family' I think? Inside might have been the safest place for Szach?
 
Who was the Police Patholigist that declared Clinton Trecize body not to be his after it was found buried at lower light? For those of you unaware, Clinton was the first victim of John bunting and Robert Wagner. Had he been properly identified, those two would of been suspects. Chances are many other disabled and vulnerable lower class members of Adelaide would of not been murdered and tortured as they were.

Surely not this same one we're talking about with respect to other two above?

Tresize was murdered 1992 and body found soon after? Bunting never murdered again til 1995. How would the link have been made earlier. When was Tresize body identified?

The investigation began to take shape after Elizabeth Haydon's brother reported her missing within days of her disappearance. Her brother did not believe her husband Mark Haydon's explanations for her disappearance, which seemed to contradict each other in varying versions he gave, and the brother also did not believe she would leave without her two young sons. Police found it suspicious that her husband had not reported her missing, and investigated her disappearance. Elizabeth Haydon (d. 1998) was closely affiliated with all of the murderers, so they all fell under close scrutiny once police started their investigations.

The discovery that Trezise (d. 1992) and Lane (d. 1997) had known each other was one of the first clues in the police discovering that there was more than a routine missing person investigation.

Try harder.

When they found Trezise , it was ruled by a police pathologist the body to old to be him. He was subject to a missing persons report. From that point on, it should of been murder. It was years before the mistake was outed.

Prof Bob Moles wrote an outstanding book on the Keogh case: "Losing Their Grip". His other book: "State of Denial" deals with Dr Mannock the pathologist in the Keogh case. Keogh should never have been found guilty - a terrible miscarriage of justice.
 
KEOGH RECEIVES $2.5M FOR WRONGFUL MURDER CONVICTION

Henry Keogh will receive $2.5 million in compensation from the South Australian government after his conviction for the murder of his fiance Anna-Jane Cheney was overturned.

Mr Keogh, who has always maintained his innocence, served about 20 years of a 25-year non-parole period for the 1994 murder of 29-year-old Ms Cheney who was found drowned in the bath of her Adelaide home.


In 2015 an appeal court ruled that the jury in his second trial had been misled by pathologist Colin Manock and there had been a substantial miscarriage of justice.

A third trial was ordered but in November that year prosecutors ultimately decided not to proceed.

Attorney-General Vickie Chapman said Mr Keogh had contacted the previous government in May last year seeking an ex gratia payment recognising the length he had spent behind bars.

She said the current government took the view that settling the matter was the most appropriate course of action.

"There is no winner in this case," Ms Chapman told reporters on Monday.

"There will be some in the community who take the view that this settlement is an amount that is hardly adequate for a person who has spent 20 years in prison in respect of a conviction that has been quashed.

"On the other hand, there are those in the community who take the view that Mr Keogh should not receive one cent."

Ms Chapman said she did not expect the settlement to change anyone's mind.

The murder became one of South Australia's most high-profile criminal cases and was subject of numerous appeals, including one to the High Court.

The decision to overturn the conviction came after the state government passed new legislation allowing for another appeal in cases where fresh and compelling evidence had emerged.

It was that evidence which cast significant doubt on the expert testimony presented by Dr Manock.

After his release, Mr Keogh indicated he was looking to be compensated for his ordeal.

"The government, politicians and the criminal justice system in particular, they're all strong on accountability," he said.

"I think if accountability is good for one, it's good for all."

Still ongoing. The amount of money this must be costing is mindblowing.

South Australia's Police Commissioner Grant Stevens says it would be an "understatement" to say that Henry Keogh remains a person of interest in the murder of Anna-Jane Cheney, despite Mr Keogh receiving a $2.5 million compensation payment from the State Government.

Commissioner Stevens made the statement while giving evidence to a parliamentary committee investigating how the Government came to award Mr Keogh the compensation sum earlier this year.

He said SA Police was not consulted in the process, and told the committee Ms Cheney's murder remained an open, but not active, investigation.
