In light of certain recent alleged criminal acts by AFL players and discussion of them here, it is timely to be warned that our posting should be tempered with care.

Whilst this story is not about football, it is about defamation actions taken against anonymous posters on forums.

Take care not to defame because you can be tracked down and sued, apparently.

I am not accusing anyone of it, this is just a friendly reminder that I thought worth sharing.
 
That reminds me of a couldabeen champions routine they did on radio (it may have made it onto their best of cd) where the basis of the skit was you could basically call anyone anything so long as you prefaced it with "with all due respect".

So "with all due respect you are a tool" :D

WH wouldn't even bother reading some of the sh*te posted on here......if he did, he'd have a good chuckle and legal action would be the last thing on his mind...pretty sure.

Good call; I read this article this morning and thought exactly the same thing. Over time, this sort of action will become more prevelent but of course it is harder to sue when the motivation is not fueled by personal gain. All, the same, it is a nice case becaue it pushes the publishing responsibility on the poster and not the host.

I think that if anyone posts stuff, particularly of a criminal nature, that can not be substantiated by evidential fact, you really are taking risks that are probably not worth taking.

Unfortunately this will probably proliferate. The issue is the written word. Once its written and posted you can't take it back (it becomes evidence) and with regard to the net it is then in the public domain so while you may reply directly to a post on a forum such as this the rest of us can read it and depending on the content it could be considered defamatory.

People have already been fined for advertising on facebook without the 'proper authority'.

People have also been sued in the US (there's a surprise) for defaming peoples character on the net.

The assumption is that 'I can say anything I like about anyone or anything I like' which is fine in the privacy of your own home, as it always has been. But as is the case when we're out in public you can't neccessarily get away with the same attitude, and while its been a little slow to catch up the same thing is now occuring with regard to the net, you're out in public so to speak, be careful what you say.

Verbal discussion can be hazy; he said/she said senarios abound so who is really telling the truth. Written discussion is black and white, no ifs, buts or maybes, then you just have to find the writer.

Sooooo...... in summary you two are nicked and I have already advised the proper authorities.:D

I hear your scoffing IB, and I agree with you in that it would be impossible to censor the net, other than to shut it down but bear in mind this is primarily about individuals posting on the net, not the net itself, its only a communications medium (the messenger so to speak).

Laws that can't be enforced make a mockery of justice. There has to be damages to the persons "brand".

If a post on the internet costs someone lucrative sponsorship deals... well ....

and anyways, any mod on here could tell you I use several different IP addresses and there's no link between myself and my online persona. Not saying I couldn't be "found", I'm just saying they'll have a damn hard time doing it.

I've always employed a certain degree of paranoia when it comes to the internet. Thats why I don't have any sympathy for those who are victims of identity theft from internet usage.

A bit of common sense goes a long, long way.

Former Eagles and Brisbane footballer John Gastev has lost his pterodactyl pilot license after rumours surfaced online that he had flown one of the beasts to the moon.
A top Greenpeace official is believed to have accompanied Mr Gastev on the cruel voyage, which resulted in the flying reptile sustaining frostbite and hypothermia.
It is believed the trip was funded by the late Dick Pratt, and was endorsed by the Carlton Football Club.
