I have an old car that I am planning on gifting to my brother in law.
He plans on flying to Vic to pick it up, and is driving it back to Adelaide where he lives.
The car is registered in my name but currently uninsured.

Considering he is thrilled to be taking my POS, I assume he wont have insurance taken care of.
Therefore my question is, am I liable for any accidents prior to him transferring it into his name?
I obviously couldn't give a stuff about my car, but can I be sued by a third party etc

Appreciate any help
 
If the car is registered in your name, and there is an accident, then you are liable for the accident. Transfer it to his name as soon as possible, because until you do you are vulnerable.
 
the smart move here is to cancel the registration and get a pro-rata refund.

explain to your brother-in-law that the car is unregistered and uninsured and once he takes possession of it he is responsible for doing whatever he wants.
