Sony wins appeal on AU mod-chip decision

The Federal Court has overturned a decision it made last year legalising the use of modification chips in Sony PlayStation game consoles.
A year ago Federal Court Judge Justice Ronald Sackville ruled that the devices, which allow Australian PlayStation and Xbox owners to circumvent copy protection technology to play games that have been copied or imported, were not illegal. Justice Sackville found that the technology that the mod chips disable could not be classed as a copy protection measure as it also prevented legal activity such as playing back-up copies of legally acquired games.

However, yesterday, the Federal Court upheld Sony's appeal against the decision, and ordered that the company be awarded legal costs. The chips are now illegal.

The decision comes as a blow to the Australian Competition and Consumer Commission (ACCC), which intervened in the orginal case to argue in favour of upholding the chips' legality.

"The ACCC has long believed that region coding is detrimental to consumer welfare as it severely limits consumer choice and, in some cases, access to competitively priced goods," said former ACCC chairman, Professor Allan Fels at the time.

"The ACCC was concerned to ensure that technology which can overcome these unfair restrictions remains generally available for consumer use."

The court's decision is a victory for Sony, which has long argued that the technology was designed to prevent piracy.

However, some industry observers see the decision as defeat for consumers who are coming under pressure from corporations seeking to increase restrictions on the way they use legally purchased copyright material.

Earlier this month Stephen Peach, chief executive officer of the Australian Record Industry Association, said that making a backup copy of a legally purchased music CD was illegal, and rejected suggestions the law should be changed to allow it.

"Once you legitimise home copying then everything becomes home copying," he said.
 
Owning a chip is not illegal, but selling them is.

Personally I'm all for mod chipping, I had one in my PSX.

It really comes in handy when trying to play games that don't come out in on PAL, arguably the worst region.

I have my mod chip to thank for Chrono Cross, one of my favourite all time games...had to play this on my mod chip as it didn't get a PAL release for some reason.

There are literally thousands of games we miss out on with PAL.

Place in Brisbane (Stones Corner) has a big sign out the front "We install mod chips" or something like that.

You chip an Xbox and it is just a PC with a few extra connections. You can put in a bigger hard drive, new software etc. $55 and you have a complete home entertainment system, playing ripped movies from a networked or local hard drive.

Add to that that you can connect it to your PC and transer games etc.

Don't count on it... the understanding I have is that if you've modified the hardware, you're banned.

But if you're that happy with the cheap home entertainment system, you might as well buy a new Xbox for Live play.

That's incorrect, mod chips have an on/off switch, which enables you to turn it off untill it comes out. Even still you can use a program at the moment where you can connect through cable and play multiplayer, it's awesome playing games like unreal tournament on the projection screen with 8 of ya friends from all over the world :D
 
The theory is that if you've opened the box up, no Live for you.

I'm sure that somebody will manage to circumvent it eventually, but geez, you guys are lucky that I'm not running the anti-piracy division...
 
I was also under the impression that if you got your PSX or PS2 modchipped then it broke your systems warranty. Bit risky if you got one brand new - but worthwhile if you have had it for a while and stocked up on cheap games in Bali!
