He'd be straight in gaol. So should she. And who cares if he booked it all, etc. If you pick up a girl, take her home, go to the bedroom, and she says no-if you keep going, its still rape.

Yep, and its sets a nasty precedent now.. Some guy takes a drunken girl home didn't hear her "no" and now can argue it's an "accidental" rape.

Doen he not have the right to say no?

Even if he had organised the stripper, said yes, and then right before penetration changed his mind, he still has the right to say no.

Look at the case of the 30 second rapist . Where consent was withdrawn during sex. The man was charged and convicted of sexual assault.

Surely this man should be afforded the same right to say no, whether before the act, or during.

It is only briefly mentioned in the article, but I'm assuming the defense was based on her accidentally doing it? Did they call it the fusilli jerry defense?

In the case you are referring to the guy has confessed.
Has he walked free from court?

By the way, I'm not excusinng the stripper, but both the victims put themselves in the same vulnerable position. All you guys are saying a man would be instantly jailed if the roles were reversed, I'm just showing that they wouldn't.

Good point. But the circumstances are still quite different. One was dealing with the ability to continue giving consent and the other was dealing with consent explicitly not being given.

Although its quite harsh, I think that both the stripper and the shrub-shagger have committed rape. I'm still undecided if either should have been convicted though. I could never be a judge.

No. These cases are quite different.

In one case consent was explicitly not given.

In the other case it was given. However the point of conjecture in this case is whether consent was still provided when she fell asleep.

But keep banging on about how women are hardly done by.
