Was very disappointed by the end of Saturday night, where a unknown male assaulted me.

The story - Was out at a nightclub with mates and found a girlfriend's mate who was looking for my missus who was missing. Leave the nightclub (At this moment I'm tipsy but not absolutely sloshed) Wait outside the nightclub for around 5 minutes until a bloke around 20 years old walks upto and claims he's been kicked out, explain he should probably leave and enjoy the rest of his night. (Bloke walks off) 5 mins later the same man walks upto me and says I got him kicked out, (which wasnt the case) Bloke decides to right hook me, shocked I ran towards the secuirty guards outside the venue (Note: this is 50 metres away from the club) (There was him and another male(I was with my GF friend)) Bloke runs after me, I trip over and badly sprain my shoulder and hit my head on footpath, (10 metres away from entrance to club) bloke kicks me twice in the ribs before getting dragged down by security. Bloke bails and I'm left on ground surrounded by security claiming I should go to hospital (I dont) and say I should be OK. Secuirty claim I can take legal action because they will have footage.

Anyway what Im posting for is some advice from people that would know anything about the law or somebody has been in similar incident.
I have put a statement in, does the police take these kind of acts seriously?
Compensation? (Will be out of work for a minimum of a week with jarad shoulder and possible broken ribs(xrays needed))
Just any advice in general would be really helpful,

The police definitely takes this stuff seriously but you kind of need to do the work for them.

Back in 2007 I was subpoenaed to give evidence after my mates were assaulted in a nightclub. It was a 5 on 1 (then my mate jumped in making it 5 on 2) and my mate got some minor rearrangement on his face. Went to the police station, they took photos, we gave evidence, ran through the process, gave evidence in court, bloke had a few priors, got given a good behaviour bond and costs.

For those wondering, I wasn't even in the club at the time, I was waiting outside as we'd decided we were going home and mate 2 went to go and grab mate 1 and saw he was getting done. Anyway, I got a free flight home for half an hour in court. Good experience.

I hate modern violence. I have no idea if this is true because I didn't experience it but it seems that in previous generations there were unwritten rules about fighting. One-on-one, no weapons, punching to win the fight rather than punching to knock them out. I hate fighting. Never been out and thought, gee, wouldn't mind roughing someone up for a laugh. I'm not small either. 6'2" 84kgs but would be useless in a fight. I just don't understand the thought process.

If you want to be macho and fight, join the army or join a boxing club.
 
What would be the point? The bloke will claim he was drunk, get a slap on the wrist and be told to attend an AA meeting (Which they will never do) and be back out flogging some other innocent bloke the next week.

Neither the police or the legal system gives a shit sadly.

I think what has happened to you is assault and battery. I believe assault is having a reasonable fear that someone will use harmful force, whereas battery is the force itself. Eg. Someone abusing you (verbally) saying they're going to bash you would be assault. Someone saying that and actually striking you would be assault and battery.
 
Ring a lawyer, you can get a compensation pay out as a victim of crime if you were hurt and have seen a doctor about it. While the police are unlikely to catch or charge the guy that did it you can be compensated for it.

Re-read the original post, security held the bloke and he was bailed.

If Security at a club are advising you to lay chagres then I'd definitely proceed, it means that they saw it and you have witnesses and a pretty tight case.

I thought he ment the bloke bailed, meaning he got outta there, either way.....

If I can recall properly from Yr 11 Legal Studies, criminal charges of assault include both threat and physical act. Although in civil cases, battery is the physical act and assault is the threat. I think.
 
I'm pretty sure he means the guy got away. Either way I would take action and if they have footage and guards saw him there should be a good chance they can catch him, especially if his a regular at the club plus they should have his ID on record at the club (that is what they do when they take your card right? Putting you on file or whatever.)
 
Yeah, definitely meant he got away.

Having said that do they know who this guy is?

Id just let it go and move on, these things happen.

I've been punched before by a friend of a friend who was drunk. The following day he asked our mate for my number, gave me a call and apologised so all was forgotten about.

One of the most scummy acts I've seen was at a wine festival at the end of last year. There was about 10 of us sitting around a table outside enjoying some drinks, and two guys asked if they could sit near us as there was no other room available. We said that was fine and naturally started chatting to them, seemed like good guys. They were hanging with us for the afternoon and I could see one was clearly not comfortable talking with my gay mate. We were all chatting about his partner who was overseas, asking how he's going rah rah rah. Few more minutes pass and one of the guys goes "so you're gay?" my mate laughs and says yeah thought'd you'd have gathered. Almost straight away this guy takes a massive swing, punches him right between the eyes and runs off. My mate is standing there with a bloody nose and broken sunnies, a few of us run after him but he'd jumped a fence and was gone. His mate tried to sneak away but we caught him and got security & police involved. Eventually the guy blurts out the pricks name and he's now awaiting his date in court. :thumbsu:

The government.

It falls under victims of crime compensation. He'll probably get around $1000. More if he can prove he will miss work for a week.

And you're wrong about cops not caring. The more people who apply for victims of crime compensation, the more the government give to police budgets.

So yeah, there goes your theory about police/legal system not caring.

Police will definitely take it seriously, it's a violent crime. If you can be bothered going through the process (can be long winded) you definitely should, scum like that deserved to be punished.

A person I know actually didn't go to the police but found out the identity of the person who punched some of his teeth out and demanded they pay him $500 for medical costs. Another option, but obviously a lot more difficult.

I'd definitely want to chase it up if I was missing a week of work from it.

This. Assault vs Battery distinction is mainly for a civil suit rather than a criminal charge. That's the case in Victoria anyway, but I doubt SA would be much different.

Managers ear got bit off for trying to help a lady getting harrassed by 2 homeless people.
