Yeah, I think the only "fact", as such, is that he tested positive. the rest is just speculation.
The circumstantial evidence is pretty bleak. He did recover quickly, there seems to no good reason for him to take a diuretic in that instance, he has the motive for taking steroids (World Cup approaching, looking over his shoulder - so to speak - at up and coming spinners), his body shape altered fairly dramatically over a short time. And, one we may have overlooked, he has stated in the past (in relation to the phone sex incident) that the only thing he did wrong was getting caught. If that's his attitude, he may have deemed the risk one worth taking, considering his career may well have ended if the recovery was too slow.
But none of that is hard evidence, and none can really be taken into account come the hearing.
Nevertheless, the onus is on him to come up with a good defence. "I was stupid" won't really cover it.
