Been in the news for two years


Has it? I've not heard it before, not that I pay too much attention to the trash that is called 'news' by most media outlets though.

In any case, horrible story all round and certainly not something Harvs or the club would want hanging 'round.

Terrible story, appears to be some neglience on his part.

Lauren's parents told The Sunday Age earlier this year they want to know who was responsible for the drowning - whether it was Harvey, the agent managing the property, the council that allegedly failed to inspect the pool, or the builder.

What about the mother and father that weren't watching their child.... nah
 
If it can be clearly established that Harves was made aware of this issue and failed to comply then yes.

Not sure the action beyond that, civil case?

Contributable neglience. But yes, the parents should have been watching the kid.

Property managers act as a liason.

The final say in any amendments to the home fall into the hands of the homeowner, however if the property manager failed communicate correctly they are subject to blame.
 
C'mon it wasn't even his house when the people were there. If they were so stressed they could've fixed it.

Ok, so the parents (tenants) were aware of the problem yet did not do anything to protect their child?

At least they should have kept an extra close eye on the child rectify the problem and sue for damages or move out of the house and sue for damages. If they is a risk to your child you dont ignore it you take action to remove it.

Very sad but its the parents fault ultimately.

I agree.
Unfortunately there is every chance that the law wont see it that way though.

Of course - no responsibility lies with the parents who were off with the fairies while their kid climbed the damn fence in the first place?:rolleyes:

**** me modern parents give me the shits - it seems to be a case of have the kid, collect the baby bonus and then outsource any parental responsibility to somebody else.

The regulaton of swimming pools is completely arse backwards.

Hence we get worse TV censorship laws, video gaming censorship laws and the ultimate in democracy crackdown - Internet Filtering. All because Parents can no longer parent and the government feels it has a right to be everyones parent.
 
Im sorry to ruin the anti parent party here, but if Harvs was made aware of the fault and neglected to rectify the problem he's at fault.

In a perfect world, parents would be able to look after and watch over their kids all day, every day, that just wont happen.

A pot will overflow, a phone will ring, a knock at the door.

It doesnt take long.

If Harves was made aware of the problem, was ordered to fix the fault and refused or neglected to do so, he is negligent to a degree and subject to penalty

Get your camera out. I agree totally with Brades. We have become the Nanny Nation where everything that is seen as an evil because it is abused by some minority that the majority have to suffer.

Punish the foolish who break the law and abuse the system. Leave the majority to make their own decisions.

...and unfortunately sometimes accidents occur when no-one is to blame.
