He's been found guilty on two counts of opportunist digital rape. It's a serious offence but there are factors that determine the sentence compared to other rapes that are planned, violent and prolonged.

He didn't damage her physically with either the rape or a beating. He didn't taunt her with insults or ejaculate inside her. If it's his first offence then it might be a fair assumption that there is a low likelihood of re-offending.

I included the victim impact statement in the aggravating factors. Clearly any rape victim will have psychological harm.
Fear, humiliation, stress, ongoing stress, all manifest in the body.
These negative factors all have physical responses and they are damaging short and long term.

He may not have taunted the victim but pressuring and gaslighting at the time and afterwards, would have a similar effect.

Rape is rape, it is not about ejeculation, nor as has been pointed out by someone else previously, about a penis.

Making a 'fair assumption' that his actions during and afterwards, his lack of contrition, doubling down on his lies, continually gaslighting the victim etc. would point to a high probability of recidivism.

Its the first I have heard of this case until yesterday to be fair.

Im gathering this was the least kept worst secret in Melbourne.

Hardly heard a whimper of the storylines of this up in Sydney to be honest.
Fair enough. In Melbourne, I reckon half the population knew.

Compare this case to DPP v Holland [2023] VSC 510.

The offender had a long list of previous convictions for violent offences, and is likely to reoffend. The victim was detained and incapacitated for several hours. Holland pulled the victim's pants down and inserted the barrel of a rifle into the victim's anus, causing damage to his rectum. He then put the rifle barrel (presumably covered in excrement) into the victim’s mouth - an act designed to degrade and humiliate him. The victim was unable to give an impact statement because he was murdered as part of the same incident.

The sentence was eight years’ imprisonment with a non-parole period of four years and 10 months. Tom Silvagni has also been found guilty of rape but in very different circumstances. I expect he will be given a lesser sentence than was given to Klay Holland.

Where'd you get opportunistic from?

It was premeditated. He wasn't in bed with her and all of a sudden r*ped her, he planned the entire rouse.

Ejaculation is an aggravator in sentencing.
