My eldest son's girlfriend (23yo) recently lost her job as a junior para-legal, mainly due a dispute about the old 'other duties as directed'.

While she had a reasonable argument from the start, she misunderstood the company's good will in preparing to compromise her grievance as she then sent a long list of 'other tasks' to her superior that she claimed she was 'forced to undertake' and were 'beneath her'. This list included some tasks that were actually part of her duty statement - surprisingly the company was still prepared to negotiate.

It then came to a head when she refused to take notes in a meeting one afternoon (as relief for an absent colleague), where thereafter the company sent her a warning notice stating that 'failing to follow reasonable instructions' was not acceptable for her continued employment.

In her response she then (unwisely) sent a long email to her supervisor and CC'd the senior partners of the firm that included specific clauses from the Fair Work place Act. where she basically claimed she was being unfairly mistreated and unless these conditions improved, she would have no alternative but to pursue the matter further..!!!

She was 'let go' shortly after....

Concur - and the other tasks she was apparently 'forced to undertake' causing her such; quote 'trauma' and 'belittlement' included such things as - replenishing the copier with paper, buying additional stationary, supervising AC maintenance people, delivering mail to restricted areas of the office, preparing coffee/beverages for clients, helping put up Christmas decorations - just to name a few on her list.

Poor girl, obviously she's happy to have left that despicable workplace environment and must surely be delighted to be now working part-time at a child care center for barely a third of the income...

It's not her job though, she was asked to do somebody elses job. This is Americanized Australia at it's finest companies are not willing to hire as many staff as they used to.

In government they now give all the VPS 5's the workload a VPS 6 used to receive and pay them VPS 5 wages. Good on her for fighting back, she actually had a case sounds like she was discouraged from pursuing it further. Anyone with a brain would realize Fairwork will still look at it. It's now become unfair dismissal and the company dug their grave.. but lucky for them she decided to drop it.

It's not legal for them to employ you a level below the actual work you are doing. Despite it happening everywhere lately. The employers weigh up the risks and there are no consequences, same calculative s**t that ended up with rio tinto blowing up that mine. Fair work do prosecute them but employers have found intimidation usually stops enough victims from contacting fair work.

Every job thesedays has scum employers trying to milk extra out of workers without actually displaying any willingness to pay them extra. Things that aren't actually part of the job position. It's sick

Yeah go to fairwork. She was asked to do things outside of her job description, refused and was later fired for it. That's an open and shut case when they actually fire her for it.

Sounds like she lives around a bunch of farmers who have warped her views and talked her out of pursuing it. She was fired for not being a "team player"... the scum boss wants timid staff he can exploit without fair work looming over his head.
