Absolutely insane. We are in for very dark times with governments and the installed judiciary that prefer to.punish people for something they have said proportionally far harder than actual murder and rape. At some stage these people need to be held to full account themselves for what they are doing to ordinary people and what they are doing to not properly punish real crimes

I don't understand what's wrong with mandatory sentencing. Surely it's better that punishment is determined by the people elected by the people. Judges aren't representative of society, they're elites born out of a dysfunctional industry. Judges do procedure and directions, parliament does punishment. It then reduces court costs by eliminating judges time taken to prepare and deliver sentencing reasons. Silvagni found guilty of rape, easy, first offence, 6 years, non-parole is a fixed % and discounted for a guilty plea. Everyone is treated equally following being found guilty. Then it's in the hands of dept of corrections to determine suitability for stuff like home detention. And you don't need to do it all at once, just start with anything you want, determine the matrix, debate it in parliament and pass whatever it ends up being. One down, what's up next, let's go.

I think the most crucial thing is to take power away from activist judges who are picking and choosing what sort of sentencing gets to be applied based on their moral compass and not the crime. Thats got to stop.
