To be fair to the company, I am sure there isn't some big fat corporate-type behind a giant mahogany desk smoking crack wrapped in a $1000 bill saying "Nah can't help ya. Just can't be stuffed with the paperwork to be honest".

No doubt there is reason behind their decision. Not that it would be of any consolation to a family who were trying anything to save a loved one. :(
 
Litigation.

You are right of course. It is a huge concern for most companies but we are talking group tort cases for harmful drugs. I just don't see how a dying man can sue a company for giving him experimental drugs because he is still dying.

The most logical reason is that these drugs make them millions of dollars, sometimes more than the occasional lawsuit will cost them. The companies need the clinical trials to be favourable and then they mass market the drug and make their millions quick. Giving the drugs to someone with a lesser chance of making it before they have had their chance to make their money, has the potential to adversely affect its reputation. Patient testing xyz drug dies = loss of millions of dollars. They pick and choose their targets.
