I think he would need leave to appeal to the High Court and if the decision is unanimous (it seems to be) then being granted leave to appeal is unlikely. This part is probably done and dusted.

I was just thinking on that. Kenny's decision was a total rejection of every point raised by Hird. Thats two highly definite rejections of the contention that ASADA acted improperly. Surely that can no longer be put up as an argument.
