Regardless of the legal outcome, their club single handedly has led the AFL down its darkest years in history, and put an asterisk over 3 years of high quality footy. How can a panel appointed by the AFL and supposedly paid by it be considered impartial and above all approach?

Every time Essendon and Hird have faced a body independent to the AFL whether it be ASADA or the courts they have been accused of doping violations or have failed in there quest to have the allegations thrown out.

Yet this time the outcome is exactly what the AFL wanted.

It's all starting to make sense now, ASADA was never going to prove which players got what without confessions and couldn't go down the intent route due to two vital witnesses pulling out at the last second.

Essendon verdict: ASADA case failure likely caused by witnesses not appearing.

Both anti-ageing clinician Shane Charter and pharmacist Nima Alavi declined to swear statements or appear before the tribunal judges.

Charter on Tuesday told the Herald Sun: “Given the process that ASADA led, the case they took to the court was never going to get over the line.

“Any way you look at it, the players were duped.”

Both Charter and Alavi had detailed their knowledge of the supplement program to ASADA prior to the authority’s decision to issue infraction notices against players last year.

Their information had been so crucial to the ASADA case, the doping watchdog went to the Supreme Court in an unsuccessful bid to force them into the witness box.
