Deterrence is only one element of sentencing.

Punishment, community expectation, community safety, rehabilitation etc, etc.

I don’t really want the US model but 3 years for raping someone does feel pretty light on, coupled with the fact that most of us were shocked it was THAT long, I think it’s fair to note that sentencing is a mile out of step with the community expectation.
Its graded. Grade one is the most....i don't know the word...rapiest. Grade 3 is the least. This is grade three.
Do you think he should have got the same penalty if he'd tied her to the bed, and forced his **** into her and made her pregnant.
If not ...stop oversimplifying things.
 
If everyone is to follow the "family honour at all costs" edict of some on here then I assume some people have no problem with the victims family murdering the Silvagni clan?

I mean firstly their kid r*ped your daughter/sister then to top off the Silvagnis are also calling her a liar

Under the "family honour at all costs" ethos then surely that would justify having the entire Silvagni clan wacked? Yes?

Yeah seems a fair sentence to me
The first incident could almost be put down to drunken idiocy.
But the second incident ...nasty.

Still not in the tier of severe rapes that happen in our society, but deserving of the penalty he got.

The judge clearly stated it wasn’t anything like drunken idiocy.

So him quite deliberately setting up that the other guy was coming back, then very deliberately trying to pretend to be him and doing what he did, whilst also lying about who he was was a bit of drunken idiocy.

After reading the entire time line, i have to think that out of everyone at the premises at the time , Tom was the most incoherent.
Whatever he thought he was doing , he was ****ing wasted.

I’d pick the bear, every time. At least I’d be believed without question and no one would try to water down the bear’s intentions or make excuses for it.

It’s truly incredible that in all my time drinking and doing party drugs I’ve managed to not only never rape anyone but never tried to pretend to be someone else just to rape someone if it’s as simple as just being hammered.

He didn’t even submit intoxication as part of his own defence.

After I read the entire time line, it seemed he was very calculated to me & knew exactly what he was doing. He wasn't wasted enough to cover up his actions afterwards & begin his plan of cover-up.

And besides, when is alcohol used as an excuse/reason to rape?

In Melbourne there are guys who preyed on women. They would study their movements. They would intercept them on the way home, drag them into the car , and forcefully put their **** into them.
To sit there and say, rape is rape, predator is predator, is massive oversimplification.

There are all sorts of low lives out there. Tom Silvagni is a young guy who ****ed up. Whether or not you mob imagine him to be a serial offender in your imaginations.

I'm well aware of the creeps out there & the violent crimes committed against women.

How exactly did tom not prey on a young vulnerable woman who believed (because of his lie) that her boyfriend was getting back into bed with her?

Aside from extreme physical violence (which given she was restrained is pretty subjective to the victim) I don’t see all that much difference except that this is the only time he got caught

I never hit the drugs, but i never even got close to raping anyone either. I did put my hand on a girls breast once and she slapped me a ripper. when everyone turned around and asked what happened. She just said " he deserved it " and i nodded my head in agreement.

But i know other people who get drunk and get horribly violent.
And others who do other things.

I did not say it was ok to rape someone because they were hammered, i said he deserved the penalty he got, and on the scale of rape, its grade 3. Which is what the charge was.

If he'd stopped after the first instance , the girl might not have pressed charges. but after he got physical and forced his way the second time, absolutely he was way out of line.

Predatory behavior is typically not a 15 minute timeline.
