our medico's could have done everything 100% just like the crows medico's may have. doesn't stop someone pursing legal action for compensation

Compensation for negligence can only occur if negligence can be proven.

If a Doctor treats you for something, does it without breaching his duty of care but you still don’t get better then that’s not negligence.

You don’t get cash simply because you can’t physically do something anymore. That’s what income protection insurance is for.

He would need evidence that we were negligent in his treatment and forced him to play through multiple concussions.
It would be extremely difficult to sue the club if Paddy himself, after multiple consultations with independent medical staff, decided to play on and got re-concussed.
It may already be too late for the club. Probably should've pulled the pin on Paddy at the end of last year.
 
You don't need to be a Doctor to see that Paddy gets concussed when the breeze changes direction. No Doctor in the world can fix that.
To make a diagnosis you need to be a medical practitioner.

I would suggest, cooperrules, you, or anybody else making statements about anybody's health is based on ignorance, and furthermore you are not qualified to make those diagnoses.

Anyone saying its a no brainer is inferring all the available evidence is in. Considering none of you have a clue of his condition it is fair to challenge the prognosis.

As for Paddy, I reckon he is a wasted pick and will never make it regardless of his health.

However this arrogance from unqualified nobodies is the issue here and I have a right to question patently uneducated and unqualified opinion.

I'll disagree there Joff. He did and does, training included.

According to the Harmonization legislation introduced in Victoria around 4 years ago, each level of leadership carries responsibility for putting the individual at risk, including the individual themselves.
It would be foolish to think this would be the Death Stars problem without Saints carrying any risk.

The way its headed across the league in the concussion space I can see a class action in the future. Koby Stevens, Paddy, Picken Sean Smith, ...... the list is growing rapidly.

that's great but that's not what i was arguing nor what you stated! dont disagree with what you wrote either btw but its just very different to the original claim

the claim was that legal action could occur not that they would be successful in obtaining compensation

Has anyone got any updates on how Bytels rehab is going , is he still just walking or jogging ? and Jake , i have a feeling he has carried that back complaint for a while judging by how he was running last year (i maybe wrong on that one , just his action didnt look flash )

He had operation 1st of Feb , had Feb off and is back at the club doing rehab now.
Doubt he would play this year , I just hope he fully recovers and gets ready for a full preseason next year.
He said to be a classy player and no one went never him in the draft because they knew he had to have a back operation , looks like we might have a good one here.

Jack Bytel is set for surgery after being plagued by stress fractures and a bulging disc in his back since last year.
"We knew when selecting Jack that his injury would likely require surgery, but we wanted to see him complete a block of rehab training to know for certain that it was the best option," Saints head of football Simon Lethlean said.

"The specialists are confident this procedure will allow Jack to put this injury behind him and we look forward to Jack becoming the player we know that he can for the Saints over the coming years."

ST KILDA skipper Jarryn Geary has undergone surgery on a corked thigh and is expected to be sidelined "for a while".

Geary experienced severe pain from bleeding in the muscle after the Saints' 40-point win over the Demons on Saturday night and was sent to hospital.

The injury occurred in the third term after Geary's goal-saving collision with Demon Jayden Hunt.

Coach Alan Richardson told Channel Nine that the skipper was likely to spend the next week in hospital.

"That was going to be a certain goal to the Demons and 'Gears' as we want to do, has left his man and just made body contact and so unfortunately he's ended up in hospital last night," Richardson said.

"(There was) a lot of pressure from the leg so they had to slice him open just to allieve the pressure, so he's probably going to be in hospital for a week and he won't play for a while.

"That's Geary, he's an inspirational leader. His teammates love him, we all love him, he continues to put his body on the line for his footy club and his teammates. He's a ripper."

Not sure the gap is that big when they rated D-Mac so highly that he came 10th in the B&F last year, despite playing just 13 games.

Leadership wise, sure, but D-Mac had been best 22, yet might not have gotten back in immediately because Paton did so well, so now it just means we lose one who was best 22 and regain another who was best 22, who plays very similar roles.

And we still don't have room for Hind, who you'd think could be extremely handy.

The saddest thing about Gears getting injured is that i think he was in career best form so far this year . Hope he recovers quickly as he is our captain .

It's a massive shame for Gears. I've been critical of him for a long time but he's been genuinely outstanding this year and I think he knows his weaknesses better and relies a bit more on his teammates to cover them while covering his teammates with his strengths. Done a fantastic job shutting down smalls while also providing help in marking contests for the talls and looks a lot more vocal setting up the backline in Carlisle's absence too.
