I'm not sure this is correct. I think you are wanting the tail to wag the dog. You correctly point out the political system is detached from the populace but I dont think our laws reflect this. I think you are confusing sentencing - Judiciary- with what people want

I think people are happy with the current laws in place - its the sentencing most have concerns with.

I am a libertarian who believes in direct democracy, and you're a statist who doesn't believe the existing position is hard enough, so what's the point?

If you want my view then start with every single piece of criminal legal legislation that was not directly itemised as a political election platform. This should take you about 5 years.

Tough on crime. You mean like wanting proper assessments on a prisoners recidivism chances? Wanting Bail laws to be harsher on those already given opportunities? Wanting sentencing to reflect a persons history ?

I believe there are a lot of social issues surrounding crime, literacy being one of the biggest . I think Governments should do all they can to raise the literacy rate. If these means continuing remedial education in prisons then do it. I know education is the one resource that gets cut back in any budget review and I dont agree with it.

I think parole is a gift not a right. If you think you can sit on your arse in prison and expect to waltz out then think again. If you are required to do a program , whether it be anger management , sexual offending or drug and alcohol then you do it and you do it to the satisfaction of the assessor. Or you can do your full sentence. And I have known people to choose this option

This is the reducing recidivism along with literacy and education classes

If you breach bail then you go to remand until your case comes before the court

If you have an escalating history of offending then sentencing should reflect this. If you are too stupid to learn the first time , or even the second then you have issues that need attending, do the program.

If as a Libertarian you think its ok for people to get out of prison and continue to assault people or rob from them then we are miles apart. People have a choice. The lazy choose to bash and rob someone rather than look inside themselves.
