Mobbs
A Large Portion, Yes
If you've received the Domain Names Australia bill, well, yep, its misleading. Don't pay it.
----------------------------------------
I got a bill the other day from this company, and was pretty affronted and surprised as I had no idea anything like this could apply to me.
Perusing the document further that day, I found that I was right. It had nothing to do with me, some company just mailed me about footypedia and said here add .au and give us money and we'll do it.
They formatted the invite EXACTLY like a utility invoice, you know, like a phone bill or such.
They had no right to bill me, they didn't have my services. In fact they weren't billing me, they were just asking for my patronage.
I thought it was disgusting that they formatted the solicitation to look like an invoice. If I was thinking a little less I might have been fooled, many people probably were! Surely it had to be some sort of breach.
Eventually (today), i checked it up by asking Consumer Affairs Victoria. They put me onto auDA.org.au, which is like Consumer Protection for domain names and so on.
That site had already heard of this :
Latest "net.au" mail out by Domain Names Australia Pty Ltd
Melbourne, 17 July 2003 – auDA has become aware that Domain Names Australia Pty Ltd (DNA) is sending letters and/or faxes to some domain name registrants regarding the net.au version of their .au domain name being available or unregistered.
The communication is headed “Domain Name Registration” and could, in auDA’s opinion, be easily mistaken for an invoice. To this extent, auDA considers that the communication could be misleading or deceptive.
DNA is a company controlled by Mr Chesley Rafferty, who is also a Director of Internet Registry Pty Ltd.
auDA took legal action against Mr Rafferty and Internet Registry in 2002, as a result of which Mr Rafferty gave several undertakings in the Federal Court.
auDA believes that this latest mail out by DNA is in breach of some of Mr Rafferty's undertakings, and we are pursuing the matter vigourously.
If you have received a net.au letter from DNA and you wish to lodge a formal complaint, please send an email to info@auda.org.au.
