The wording in AFL 2005 says their 3rd round selection. All depends how you interpret it, but I would read that as saying their selection before trade week.

Ok thanks! Yes one would assume that to mean they would have to use pick 39.

However, form a legal point one could argue that once a club recieves ownership of another 3rd round selection that it therefore becomes their 3rd round selection

Morally I would say Essendon should use 39 on Neagle. Legally (and also because I do have some bias!) if I was Essendon I would fight for this one.

But anything received from other clubs is not theiry 3rd round selection, and in this case it is Sydney's third round selection. If this was the case, imagine the clubs scrambling every year to get the lowers 3rd round pick, it'd be ludacris.
