In cases like these especially, people dont tend to think about what they are saying - it is simply the kneejerk reaction to the crime.

But as a society, we cannot aford to simply kill members of our society out of hand. Like I mentioned before - are you willing to accept that the state will condemn innocent people to death?

This is where I would hope the burden of proof is of a much higher level, not the burden of proof to convict, but that the burden of proof is 100% . Yes that is an odd concept , but I do think our court system convicts innocent people at times.

ie a Julian Knight would be pushing daisies for mine, yet a Lindy Chamberlain would not

No doubt our courts convict innocent people - but there is always the chance of them being released if they are shown to be innocent. CP doesnt allow that to be the case.

The judicial system doesn't really allow for a dual standard of proof. 'Beyond reasonable doubt' is just that.

I shake my head in pure dismay that anyone could have the evil in them to hurt, even torture an innocent child, whose most important thing she should have to contend with is what to wear to school and what her friends are up to.

I shook my head in disbelief when i first heard what happened and again when I heard today that the poor girl had numerous broken bones and was severely bashed let alone anything else, tears welled up just thinking what terror the girl went thru in her last minutes. What is going on in this scumbags head???

Capitol punishment???, nah forget that, make him relive the terror she went thru, but make him live it every day, for the rest of his scumbag life. Violence, mental torture, you name it, whatever it takes the inflict the pain she went thru and sheer mental torture she would have endured.
 
FuManchu, I only hope they put the guy into general population in prison. Plenty of dark corners and angry people. I've heard plenty of stories of what they do to rock spiders in prison, and to be honest I don't feel the slightest bit of remorse for what is going to happen to the creep.

There is a rumour going around that this Arthurs bloke is one of the two that killed the Bulger boy when they were ten. I sincerely hope this isn't the case. If it is, heads better ****ing roll.

I'd be surprised if he was ever allowed out into the general prison population, as he would be dead in ten minutes. The prison authorities have a duty of care, but a little slip up in procedure sometimes does happen. And yes, ten minutes just as much as he gave the little tacker, would be enough. Too bad it wouldn't be a daily occurence.

I mean to say, what did this piece of filth think was going to happen to him? live a life of comfort? Or that the cops wouldn't pursue this with an frenzy unmatched. he must be highly delusional to think he wasnt going to get caught and that at some stage would face the most severest of jail house consequences.

The police said tonight that was totally untrue, just an internet rumour.

Also, he is being held in protective custody, not in general population.

Edit: That was 13 years ago, this guy would have been 8.

Unfortunately more details are emerging of the crime that are making it progressively worse.

FuManchu, I undertand that all protective services have a duty of care to prisoners. I do beleive that in this instance that duty is purely a professional one and not a moral one - certainly I couldn't take a job there, as the temptation to dish out a primative form of retribution would be too great.

Based on the choice of wording in the police statement in response to the rumours, to me it appears that they aren't sure themselves or are sure and don't want to jeopardise the trial. I'll be waiting for a few more details to come through before ruling out that it isn't one of them.
