What`s everyones opinion on the 1.8 million being sought by Shaun Rhen.

Must say it opens a huge can of worms regarding insurance premiums for all football teams, from AFL ranked teams to struggling amatuer & country sides.

I know the small ammy club my son plays for would really struggle if the premiums soar, & to survive would have to pass it on to the players & members.

Sureley Rhen was being paid when not playing with his knee, & Hawthorn are paying him now. So wheres the 1.8 mill come into it.
Going on recent cases the insurance companies hardly need an excuse to whack the rates up. I would`nt think the AFL would pay up & not get their money back by fair means or foul.

I just have a horrible feeling if this claim is upheld by the courts it`s going to have long term concequences, that will affect all players & supporters.

Rehn I couldn't care less about him hes screwed hawthorn and given them nothing he can just retire right now and live off his 1.8million and never come near the hawks footy club ever again.Biggest dud that ever walked.Thanx for ZILCH...... ZERO..... nadda...... nothin that you contibuted to hawthorn now go back to feraltown.

Agreed with the crux of the thread. There is no way he should get such a massive compensation, the club looked after him and he was paid as if he were playing and his medical bills were looked after. Such payouts are usually to compensate a financial loss or pain and suffering, granted knees are painful but $1.8 million? People who wind up vegetables after car accidents have gotten less.
 
Rehn's payout

Reason being that prior to the injury, he was in the top10 paid players in the AFL.

If he wasn't injured, and he can prove the fault of the AFL/Ground/whatever, then he has every right to sue for loss of earnings, in this case the margin between what he 'would' have earnt, and what he has (substantially reduced).

Over the four or five years (no idea how long actually), it would be somewhere between 200-300K a year.

However, who knows what the decision might hold.

I think he has a case, and as such would be likely to receive somewhere in the vacinity of 200K a year (adjusted for interest, etc), which would end up being about 1.2 - 1.5 Million.

So by asking for 1.8, he's probably hoping for an out-of-court settlement (which the AFL will definitely go for if looknig like losing), of 1.6-1.7 Million.

my thoughts anyway, although I don't really agree with it.
 
I wonder if we'll all be talking about the "insurance cap" rather than the salary cap in a few years time.

Was this the case of the metal plate on the ground?

Really does open a can of worms if big payouts are availble for injuries related to grounds - eg would Hayes have a claim if the fences are considered too close at the Gabba? Or if some turf wasn't quite right at Colonial?

Or would it stop there? From memory, a rugby league player sued another for a broken jaw. Would a legal shirtfront which broke someone's jaw, collarbone etc and not cited before the Tribunal, get viewed differently in court?

Will we all be watching ABL in a few year's time?

Sorry i cant help the sarcasm will rehn be suing after the testomonial before the super payout from the league while he is being retrained to become an astronaut by the players assoc.
 
Well the AFL have introduced an interesting angle on this by arguing it was Rhen's responsibility to ascertain the safety of the ground before participating.

I agree it is a can of worms and the outcome will have far-raching implications.

(I trsut the speeling is satisafatory for all concerned).
