Australia doesn't have libel or slander, we have defamation, since the Defamation Act in 2005 removed and replaced the other terms. They are still used in other countries however.

Written defamation involves defamatory statements made in writing, or in ‘permanent form’. This can include communications such as emails and group messages or publications such as books, online posts or news articles.

For a defamation claim to be successful, the plaintiff needs to prove:

• Publication
• That a third party saw or heard the publication
• That the publication caused reputational damage

You don't get a free pass for 'having an opinion'. If the above criteria have been met, it is defamation.

There is however a 'truth' defence, which came into play in the defamation case involving Roberts-Smith and alleged war crimes in Afghanistan.

Secondly, I took the time to explain why the terms libel and slander have no legal meaning in Australia and that what matters is called defamation. I also explained when defamation has occurred.

But here you are still pretending you live in America or somewhere other than Australia and insisting that what matters is about libel and slander.
