Does anyone know if you can do your tax returns as a single person if you are separated but still legally married? Many thanks.

Yeah but you normally put your partner's income in there if you are married don't you?

I didn't think so. Never been married but it won't change what you get back

Read the definition of "spouse" on the ATO site.

Spouse

Your 'spouse' includes another person (whether of the same sex or opposite sex) who:

• you were in a relationship with that was registered under a prescribed state or territory law,
• although not legally married to you, lived with you on a genuine domestic basis in a relationship as a couple.

If you aren't living together, sharing expenses, etc - you don't declare the income as part of the family unit.

It also only affects Medicare surcharge (if no private health), and FTA/B, etc.
