I can only be happy about our own stance with Mason Greenwood. Charges were dropped back in early February and the club haven’t decided to welcome him back even though they very well could have.

Same with North and Thomas.

Clubs can take a stance based on their own judgement on what's not acceptable behaviour regardless of what the expensive lawyers end up arguing.
 
I'm a bit cautious of criticising clubs for not suspending players based on allegations and nothing more (as far as we know).

I have no idea if Partey has done anything wrong or not, but just say he hasn't and the accusations were malicious, should he really lose a year of his playing career?

Greenwood a bit different as what he was accused of doing is there for all to see. United in a very difficult situation, unless they come to some sort of agreement with Greenwood they will have to start playing him, or risk a breach of his contract.

What breach of contract is there? If he's not selected he's not selected. You see it all the time with players sent to train with the U23s until they leave the club.

United would be denying him the chance to earn match day income, bonus etc for non football reasons. It amounts to constructive dismissal. He's been cleared (wrongly imo) and legally can't keep on being punished.

Given I've never seen a player launch a constructive dismissal claim against a club who has done this sort of thing before, I wouldn't be holding my breath this time either.

I'm not sure there's have been too many similar situations before.

I'm not holding my breath either as I suspect United will either start playing him again or sell him.

I can think of countless cases of players being sent to train with the u23s or not played in certain games because a club wants to force them out, or in the latter case, literally just to prevent triggering a new contract/salary increase for the player. Both situations are textbook constructive dismissal or denial of a chance to earn income. Football/professional sport is a bit of a unique industry when it comes to workplace law.

Who makes the matchday squad is solely up to the manager. As long as he gets his contract paid there's no legal recourse. Because what you are suggesting here is players can dispute the decision of their manager in a tribunal.

No, if a player isn't getting selected for footballing reasons I wouldn't think he'd have a case for restraint of trade/constructive dismissal.

Although isn't there a rule now where you can terminate a contract if you play less than a certain % of club games? Or did I just dream that?

I think you may be right. But only with a certain amount of contract length etc etc.

28+ can buy themselves out with 2 years or less on their contract (Webster).
