A lawyer on TV earlier this evening said it was a case of theft if she took the files from his computer without permission.

not going to deny that he said that, but i believe its not so clear cut.

Anyone who has seen "The Social network" will remember Zuckerburg stealing 1000's of images from actually hacking into Harvard and other schools computers to make his "Mish Mash" farm animal website. He was not charged, but only slapped on the wrist for it. I doubt any punishment this girl will incur will be of any real issue - especially she has no priors, and is 17. The courts can't set a precedint on this, as it - in reality - happens everyday when someone copy / paste an image off a website and keeps it - or even when a kid downloads a torrent of a home pr0n video of a celeb or of his favorite bands latest album.

I mean FFS - they guy who is doing Wikileaks is only in jail for sexual assualt charges - not for his stuff with wikileaks. Comparing what he is exposing the world to, compared to what this young girl is on a completely different realm of seriousness

Where is the defamation and don't say 'I took the photo' because that isn't a defamatory comment, it's about her. Point out to me where she defamed Nick Riewoldt with anything she said, it's not like the photos came with a big long list of allegations of alleged behaviours, in fact she is on record of saying she hasn't slept with him. To run an argument that you are implying that something untoward was going on because she posted a photo is pretty thin, you'd want a bit more substance in my opinion if you were taking that on.

or reposts a photo sent to them onto their own facebook page. How many of you out there has used the image of a superhero character or a logo or an official photo that has potential copyright on it as a profile pic? that's theft by some interpretation.

You'll notice Gilbert didn't say 'I never sent her those pics she stole them from me' if that was the case, thats more along the lines of what is statement would have said rather than the stock standard meaningless response of 'in the hands of the police'

You can't compare other countries laws in regards to privacy and use of photos, files etc to Australian Laws, they are completely different in most cases. (And Don't even mention Wikileaks, it's not in the same realm as what has occurred here).

My understanding, is that Australia has very few protection laws for what other countries consider "personal property" such as photos, vids etc, unless those products were produced and copyrighted by an organisation such as a modelling agency, photographer etc etc.

Legally, the girl involved will never be in much trouble, as the police have stated publicly, the players involved have more chance of successful litigation against her then they (the police, DPP) do of convicting her on any criminal charges.

IMO, this whole "case" would have been forgotten in a month, Riewoldt and StKilda did exactly the wrong thing today by coming out and making it a bigger story of the whole situation, they should have "closed up shop", released a short comment stating that their players have no knowledge of this girl, and then moved on.

And for anyone following the moronic child on Twitter or Facebook, stop now, you are only feeding the troll (to use a popular saying).

I'm pretty sure that there already is precidence. It's illegal to steal intellectual property. Just that so many people do it that is hardly worth the effort catching the small fry.

That's weird. Wikileaks never stole anything. Assange et al. were given the stuff by others. One guy is now in a US slammer for life for stealing the info that he gave to Wikileaks. But Wikileaks didn't steal anything. There is no crime in a journalist or journalistic group revealing information given by sources. Even if Julia Gillard doesn't know the law that she should. It's apples and oranges when talking about Roogate.

Yeah she is too stupid to realise the damage this will do to her reputation is probably going to be worse in the end than the damage done to the players or the club. After being exposed as a liar and a thief that posted those pics out of nothing more than an immature need for attention, she won't be getting much sympathy from people and will always have to wear that stigma.

Unfortunately the damage done to the players and the club's reputation can't be undone even if they prove they did nothing wrong and she was at fault. I have no sympathy for her whatsoever, she's a complete waste of oxygen.
