Hird appeal dismissed. No surprises there.

So all these reports of Hird's lawyers telling him they had a strong chance of success turned out to be bullshit.


Hope he hasn't spent all that year-in-advance salary he got last year; costs won't be cheap. Perhaps little uncle Paul will help him out...

A pity, if Hird had won, Essendon would have have been stuck with him forever, and our Angus and our Paddy would be free and clear. But I never thought that was going to happen.

Whoever wins at the tribunal, it will be appealed, I would have thought.

This was in the Federal Court, next rung up is the High Court. After that he might consider the International Court on Human Rights. Failing all else, there's Judge Judy ;)

Isn't there an International Court of Arbitration for Sport? The same one footballers in transfer wrangles and swimmers who take their coaches wives' headache tablets go to?

This latest reaming for Hird was just on points of law, I doubt that ICAS would have any jurisdiction over the decision. The outcome of the current Tribunal process is a different story though.

Hird was in court because he said Asada broke Australian law. CAS only has jurisdiction over the Wada code. It also acts as a court/mediation process when some one argues a sports law/rule has been broken. Break a sports sponsorship contract and that goes thru the courts and not CAS as a contract breach isnt a breach of sports law its a breach of contract law.

If Hird keeps fighting, and let's say it lasts into the season - will the players remain provisionally suspended?

After Essendon and Hird lost round 1 the tribunal proceeded and hasn't halted for his appeal, they will play on regardless of his next step.

The link below is interesting. Apparently the NFL have a set schedule of penalties for PED abuse. It makes the possible two year ban that ASADA have waved around seem a little harsh.

Under the recently agreed codes, 'using steroids or stimulants or other banned substance in the NFL' attracts a four game suspension on first offence.

A player needs three violations to attract a two year ban.

The NFL stance is pathetic. 3 violations for a 2 year ban? Give me a break. In the NFL you can get caught taking roids and get a few weeks off. It's worth the risk for players to do it.
