Did the government psych say disturbed mind at the time?

Where did you get the full date June 1988 from please? Online I am only seeing purchase reference to June 1988 and resale reference to June 2016.

I wrote this out for Melsy the first time he claimed the accused may see his days out detained in a hospital ward playing video games between 3 meals a day, but didnt post it.

I asked if he'd like me to post it a few days ago when again he made a a similar suggestion, but got no reply as per usual.

I'll post it now & you can draw your own conclusions as to how effected someone with autism may have to be before they'll be determined not to be criminally responsible for murder.

These are the ONLY provisions to determine that outcome.

Either they are:
A) unfit to stand trial or
B) not criminally responsible on account of unsoundness of mind

In order for A to be valid, at least ONE MUST APPLY to the accused. They:
1. Cant understand the nature of the charge.
2. Don't understand the requirement to plead to the charge or the effect of doing so.
3. Don't understand the purpose of the trial.
4. Are unable to follow the course of the trial.
5. Are unable to defend the charges.
6. Are unable to understand the substantial effect of evidence produced by prosecution.
One other alternative doesnt apply to this particular situation as it relates to a jury & there wont be one.

Straight off the bat I think its absurd to consider the accused would satisfy any of that criteria, but for those people to whom it may apply, the next conversation would focus on the following 6mth period.
Specifically:
a) whether the person is unfit now &
b) whether they might be expected to become fit to stand trial within 6mths.

If they didnt believe that would occur or if 6mths passed and they were still not fit, the law states the preference is for it to be resolved without a trial occurring but I know this isnt always the reality.

In relation to this case - At any time since the arrest option A might have been raised but it hasn't been & personally, I dont see the accused suddenly lapsing into a state of such compromised mental health now either.

So, to option B where the offence determines the punishment, the evidence is tested and a verdict delivered. If they're found guilty they wont be held criminally responsible for their actions but due to the seriousness of murder charges, they would be detained regardless. The specifics required to enable this verdict is determined by the Criminal Code.

The code explains you are not responsible for an offence on account of unsoundness of mind ONLY IF at the time of the offence you were so mentally impaired you didnt have the capacity to :
1) understand what you did
2) stop it
3) realise it was wrong

Now, will he suddenly become unfit and incapable of understanding a trial or do you think that if he is eventually found guilty, on at least 5 occasions between 1988-1997, he suffered such severe episodes of mental instability he couldnt help but commit the crimes and was oblivious that it was wrong. Or....neither, which is how it stands now IMO & isn't even a consideration.

But nevertheless, thats only the criteria to enable a person to be found not responsible criminally IF one of the two categories DID apply. Theres still no guarantees of being handed a custody order detaining you in a hospital, theres more to satisfy before that can occur.

Firstly, as mentioned previously, a court can only order someone to be detained in a hospital when theres a reasonable expectation that they will be able to treat you and you will respond well.

Finally, a hospital order can only be made if ALL of the following can be said of an accused person to which either category A or B applies:
1. They have a mental illness that can be treated.
2. Because of the illness theres significant risk to the health or safety of, or serious harm to, either the accused or someone else.
3. They dont have the capacity to consent to treatment.
4. The treatment can only be administered in hospital.

There you are! Do you still think he could be a candidate for lifelong hospitalisation Melsy?

A disturbed mind is an easy diagnosis for anyone capable of killing someone, of course your bloody disturbed to even think about it. But being unsound of mind is not a bullshit verdict you try because you think you're getting off easy & you do need to be, or have been, undeniably & very seriously unwell!

I know of someone like that and I know of someone facing this exact situation too & its no joke. He's destroyed any hope he or his family had of ever getting him stabilized & having a chance to live a semi normal life. He'll be locked up for the rest of it & probably passed back & forth between jail & a locked hospital ward. And not least because if he ever gets well enough to comprehend exactly what hes done & why hes detained, he wont be able to live with himself anyway. Hes not a killer, far from it, but on this one really bad day, he became one. Its heartbreaking for his family and especially heartbreaking for his victims family whom he didnt know, had never met & had no reason to kill, yet he doesnt realise he did it so he couldnt have stopped it. Thats unsoundness of mind & if you think he could hold down a job or go 2 weeks without being hospitalised under police escort, you dont understand.

Why, because 1 appears to have whiskers & they were in a car? I dont see anything else that would make you compare them. She got in their car & they drove straight for about 5mins then turned down a track & raped her.

Why not Church Lane attacker. Similar descriptions given & identikits compare too IMO.

1996 (August) Article "Fear of serial killer after body found in bush". Claims of 6 attacks on women in Claremont in 4 years. So 1992 to 1996 & perhaps these:
  1. Subway (January 1994) Article "Woman knees attacker". Gugeri/Stirling red light, dragged from car. Escaped.
    • 1.8m, slim stringy build, blonde hair cropped in a skin head cut on top & long at the back. Faded jeans, long sleeve blue fleecy top, black running shoes, around 25yr
  2. Broken ankle/2 man Taxi (October 1994) CBV to Princess Road. Man couched in back grabbed her. Escaped
  3. Rape (before 1995) possibly Coles Loading Dock. Woman taunted by phone afterwards.Called police again after BRE arrest.
  4. KK. (February 1995) • 183cm tall (6'1") medium to solid build, dark collar length hair driving a light coloured panel van. Released naked.
  5. Golf Course/Taxi (1995) picked up from Claremont stripped of clothes. Escaped.
  6. Church Lane Attack (March 1996Article "Hunt after sex attack outside club". Bashed head, tore skirt, discovered shirt on backwards later. Fought & escaped. Article "Hunt after sex attack outside club".
    •Long sleeved denim shirt, dark jeans, 25yrs old, medium stocky build, Caucasian with dark features and dark hair.
    Article "Police look again at attack in March". • 178cm tall, olive skin, thick dark wavy collar length hair. Blue collared shirt with jeans.

Or the 2 girls who were raped adjacent to the Swanbourne Train Station in 1992 whilst walking home from CBV.

1989 (Reported November 14, 2015) Article "Kidnapped Teen in Claremont Attack".
Drunk teen removed from car parked opposite Cottesloe Hotel late 1989, transported to another car & driven to old Swanbourne Drive In, attempted rape. Escaped, recaptured on Alfred Rd, escaped.
•Reported to Police after reading SCS were investigating other potentially connected incidents in October 2015 Post article.
• station wagon or hatchback, more stocky than tall, whiskers, assumed at least 30yrs.

1994 (Reported December 22, 2015) Article "Teen lured into Claremont Car". Women in large car park likely Coles, approached to assist man finding keys in backseat of Commodore. Brother arrived and asked what the hell are you doing and they left.
• Reported to police with description of person after reading 2 new clues to serial killer article 05Dec15.

1995 December (Reported August 6 2016) Article The West Australian. Police requesting prostitute who had approached them previously about an incident in Claremont to contact them again.

girl picked up by 2 guys from Hay St Subiaco around 2am and raped down a track off Underwood Ave Floreat near CSIRO after telling her they'd take her to Northbridge.

• well dressed, tall, good looking, blonde man.
From letter to Post "Police have proof I did not abduct Sarah Spiers".

2005 (October 2) Article "I saw Sarah too: witness backs taxi driver" The Post
Reported by Mr Boudville. Saw man with SS the morning she disappeared.
• tall, well dressed, skinny with sharp features, black hair, with small curls at the back.

Fake taxi drivers
1996 (January 14) SAS guy given lift $15 from Swanbourne Hotel to Campbell Barracks (waited for him to shower & change) then onto Hippie Club. Says the white Ford had no computer or meter but had official exterior identification.

Swanbourne TAB worker Steve Harris corroborated that it was a 1980's model white Ford Falcon with all exterior decals & roof lighting. Claims it was parked at the hotel with the driver in the car from 6.30-9pm.

1996 (April 27) Another fake taxi. A couple left CBV, charged $5 to go to Swanbourne. Claim it was a white commodore without computer or meter and only when getting out did they notice it wasnt a taxi.
• Description of the driver - In his 30's, medium build, short brown hair with a European accent.

I agree. If that is the case. By 2006 the current accused would be around 38-39.

Only a followup article which is a transcript of the original Post article about 2 teenage girls who called police claiming 1 of them recognised 1 of the guys she saw in the paper that they were looking for & he had followed them from the fish & chip shop in Cott. The 2 guys were sought over a tag team style rape in the beach changerooms/toilets. Wasnt much else about it but it read as though it was widely publicized & obviously with identikits. Would have been in a December 97 issue of the Post but perhaps others too. I think they used the term "the Cottesloe Rapists" & it mentioned x amount of calls had been received. I forgot to take another screen shot & its amongst 1873 others but I'll find it again eventually. These were the only real details though.

Not sure how that would go down or how it could help their case if he hasn't been charged with any of those offences. Even if one of the victims was prepared to testify & identify him as being the person they believe was their attacker or whatever the case is, it would be an untested & unproved criminal allegation. Im not sure how if might be used to indicate a pattern of behaviour or a capability to commit a similar crime though. What were you thinking?

I'm not sure and waiting to see what gets discussed in the 3 day hearing from 14th Feb.

I'm more likely to believe Droc's group with the accused as the mystery killer who TT said he'd be surprised if he knew who it was.

Seriously, I'm sure they can argue for three days whether to split the charges or whether the two earlier indecent assault and sexual assault charges give "an inclination or natural tendency to behave in a particular way."

This is why I always clear my search history, out of context it can paint a weird picture of ones extracurricular behaviour.
