That's ironic because Brayshaw's clean past makes no difference in a charge that was also very very questionable to begin with.

Neither incident is worth a second look past a free kick. Both should appeal.

It's almost like they're playing the biggest two clubs in the country this week, both of which need to win to make finals.

Brayshaw's reputation being tarnished for the sake of such an egregious charge is why appealing it is a must for the club.

My only concern with an appeal is if the club has screwed the pooch with the way they contested the charge in the first place and the AFL will pull out the "needs to be a new angle" clause. Setting aside the ridiculous notion of this clause in response to a defence that has to be put together in 24hrs.

I don't know why he would plead guilty to the charge of "unreasonable contact to the face or eye region" in the first place (if I had to guess it's because of the closed fist maybe). They should've been attacking the legitimacy of this charge at the core of their defence though. Undoubtedly Berry's movements were a prime cause (negating the "unreasonable contact") and there's a strong case for this in the vision.

I'm not sure the intent matters in making unreasonable contact to the eyes. I expect there is a written brief on the decision submitted after the summary is presented to the tribunal which says "the player (Brayshaw) admitted to making contact with the players eyes - from there the rest doesn't matter as this wasn't a football action" to which Fremantle would see and think "ah, well that isn't a process problem and we aren't able to remove that evidence so the appeal would have the same view of the evidence and the implications"

Those grounds as set by the AFL? Possibly not.

But certainly given the tribunal cited the vision in their decision, there would be grounds that they misinterpreted that vision and bringing in an expert (biomechanics) witness would be material new to the case.

Also, they cited in their decision the hand not being near the ball. which could be appealed on the grounds as to why the hand was not near the ball (although that would be better in challenging the interpretation of the vision, as there would probably be an argument that they had a chance to argue this in the original appeal).
