Heppell suing Essendon

I would imagine the insurance company would argue that it is the player's responsibility to check what goes into their bodies. No one checked what thymosin type was being used through the correct channels and so their loss of reputation has been due to being found guilty of doping and that was due to the player's own ineptitude.
I would be arguing strongly as the insurer that I don't have to pay anything.

It's an interesting dynamic and I think those people that believe that the insurer will simply roll over at the direction of the club are fools. Ultimately, the insurer controls the litigation, not the club.

At the end of the day, it will likely come down to whether the insurer elects to defend the action with a piece of wet lettuce and potentially pays out $30m plus or decides to play hard ball (contrary to the wishes of the club) and loses the premiums moving forward.

Despite what some may believe, insurers aren't in the business of paying out claims.

Fair enough as there would be significant damage to his reputation and loss of income. I'd be surprised if the other players did not follow suit. I'd also be surprised if he left the club.
How can you sue the club and stay? o_O

Well he claimed on his first AFL 360 appearance that he knew exactly what he was taking and what was on those forms so who knows.

I certainly don't get that impression.

Even though the question was about the DCF the way he answered it talking about how they fully cooperated with ASADA from day 1 made it seem like to me he was talking about how he cooperated with the investigation. Not the day he pissed into a cup.

It's the same feeling I get pretty much when ever this gets asked to someone in the know its like everyone's been trained to deflect to how they helped and not talk about what they did wrong.

Hold on a minute, I will ask jenny she is the resident authority on all things Essendon.

Oh wait......
I asked the question because I can't honestly see how you could do that. I'm suing the Club for loss of earnings and reputation. Now I'm going to be their captain. What the?

What the **** did you just ******* say about me, you little bitch? I’ll have you know I graduated top of my class in the Navy Seals, and I’ve been involved in numerous secret raids on Al-Quaeda, and I have over 300 confirmed kills. I am trained in gorilla warfare and I’m the top sniper in the entire US armed forces. You are nothing to me but just another target. I will wipe you the **** out with precision the likes of which has never been seen before on this Earth, mark my ******* words. You think you can get away with saying that shit to me over the Internet? Think again, goose. As we speak I am contacting my secret network of spies across the USA and your IP is being traced right now so you better prepare for the storm, maggot. The storm that wipes out the pathetic little thing you call your life. You’re ******* dead, kid. I can be anywhere, anytime, and I can kill you in over seven hundred ways, and that’s just with my bare hands. Not only am I extensively trained in unarmed combat, but I have access to the entire arsenal of the United States Marine Corps and I will use it to its full extent to wipe your miserable ass off the face of the continent, you little shit. If only you could have known what unholy retribution your little “clever” comment was about to bring down upon you, maybe you would have held your ******* tongue. But you couldn’t, you didn’t, and now you’re paying the price, you goddamn idiot. I will shit fury all over you and you will drown in it. You’re ******* dead, kiddo.

Seems legit :D

Who are the other clubs who'd pay Heppell $1 million a year? He's way too short for us to consider it.

Carlton?

I'd be very pissed off if we did.

  • Priority one is to hold Cripps and Weitering - 10 year leaders of the midfield and defence. It's a near certainty that both will be high cost players moving on.
  • Hold Murphy Kreuzer and Gibbs as a core for the next generation through the middle to work with. Too easy for young players to be ruined if they carry all the weight. Couple of mature defenders for the same reason.
  • Keep enough money in the war chest to ramp up contracts for the young players who prove themselves.
Paying Heppel gazillions to take a a few percent off the many defeats we have in front of us does not make sense.

This can't be possible. I've been assured many times that Heppell is the future captain and loves the club. He grew up supporting them and idolizes James Hird.

Anyway,

Did not think of that, very interesting.

Surely it has to. If not , who is to say that the club hasnt instructed heppell to sue in order for them to legally give him a million dollar sweetener

Surely a club which undertook a club wide doping program (and the only club to break the salary cap in a premiership year) wouldn't do such a thing......

The salary cap elephant in the room is another reason player payments should be made public. It's a tricky issue because I oppose drug testing in part because it is an invasion of privacy and this certainly is that. But I would argue the speculation and generally understood figures reported about players mean that it is not far beyond what they experience already. Gun-toting Yanks worried about the King of England kicking their doors down have even grasped that it is necessary transparency.

In this case, if a bunch of Essendon players 'sue' Essendon but remain at Essendon then everyone would have some indication if something fishy was going on. Not a full idea - closed door 'salary' vs 'settlement' negotiations are still a major issue - but if it became apparent that Dyson Heppell and Hurley were getting paid 400k a year from Essendon while being offered 1 million elsewhere, even if the AFL tried to sweep it under the rug the entire country would know what has gone on.

Players need to shout Danky a shandy at the front gate, three years of not having to perform, a lazy 12 months off, and a nice little fat payout to look after your missus and mistress

Genius Danky, such a generous lad.

Ah, the Hird remuneration model.
