The fact essendon have offered to trade Hurley would hold no weight at the tribunal as its not the actual argument and doesn't effect the decision to go to the tribunal.

Youre right that there is only one question the tribunal needs to answer and that is did efc meet its contractual obligations to Hurley. If the answer is that they didn't the remedy in the contract is for Hurley to be made a dfa and that is the only outcome.

Hurley doesn't need to go down the trade path and could lodge at anytime. Efc have contacted all the invloved player managers and they stated they would use the traditional route of trading and not the dfa. That's ejat effort hopes and to be honest most players don't seem angry at the club to cause efc to gain nothing.

That doesn't mean they couldn't if they wanted too
Have a look at the HS article(Monday I think)by you're CEO where he is quoted that player managers have agreed verbally that they wouldn't take that path (dfa and tribunal).

That means the option is available but the players prefer to go through the traditional path.

Agreed it's a mess, if they went down that path he has to do more than sign a piece of paper...

I don't think anything but a trade will happen but what would happen in this scenario;

Hurley serves eft with a breach notice and request to be made a free agent. Now if essendon agree there is no need for a grievance tribunal.

Hurley/manager/new club get on the afl media circus and use the pressure to state that you have gone on record stating you won't stand in a players way to leave, I'm now asking you to honour that.

Does essendon reject the breach and make Hurley go through the process (which no one know what will happen) or do they honour their original commitment ??
The problem with this idea isn't that he couldn't apply for the process before the trade period (he could), but that why hasn't he then done so? Such an extreme move doesn't fit with any of the other information availabile that he has been negotiating around staying. That doesn't indicate a wrecked relationship. And the guy whose relationship did sour - Carlisle - didn't use this process. So do you have any reason to think this is at all probable, rather than merely a long shot possibility?

I wonder if the AFL would allow an exemption pending the result of the tribunal case. They'd have to for him to be able to leave that way (assuming it happens after the trade period concludes).

Good point.

You'd have to assume (well actually you don't) that the afl could run the process in a timeframe that allows a decision before the draft. They could do it in a month if they wanted to (I'm guessing).

You think the afl would be pretty keen to help Hurley get to his destination of a trade doesn't get done.
 
Our original commitment always included the stipulation that we expect something in return for our contracted players and I have no idea where anybody gets any other ideas from.

Essendon will help our players to move by accepting a reasonable offer, negotiating with any club of Hurley's choosing and if he's absolutely set on leaving, we'd likely do what we did with Carlisle and explore opportunities with other clubs if it assures that he could leave. If that isn't enough in terms of "not standing in their way", then I have no idea what else Essendon is supposed to do in this situation.

I really wonder how many more years of pain and torture Essendon supporters and post-2012 players should be subjected to before the torch and pitchfork brigade decides they've had enough of punishing a club for decisions made by a leadership group which has long left.

Yeah but the pain of losing two is still there. Every time something storm pops up on social media, scroll through the comments. Cheats, boats and vouchers normally get a mention and this is 6 years on.

Just management doing things they did not need to do. If they'd been honest I still think we'd have won in 07, but not 09.

Shame, really.

But AFL and NRL are different beasts. NRL you only have to deal with a salary cap. So much easier to rebuild, if you can sell the club and make smart decisions. AFL, much harder. Look how badly the salary cap cheating hurt Carlton...

Pies now have entered the race. This would be a bad result for Ess and the pies won't have the draft picks to get it done. Hurley would be a good fit with their issues down back.

There wouldn't be a list manager in the game who hasn't spoken to Connors about Hurley.

Ultimately Hurley is in the best bargaining position he could be in and he'd be silly not to try and maximise his position. He's got one crack at this deal.
