gambinotosserflog can we get an update from you on how this would likely play out in the Nagano court system?

Security camera footage played in court on Thursday, March 27, showed a group at the front entry of the venue.
Those involved, including Balta's younger brother Oskar, could be seen raising their hands and gesturing.
Balta, 25, wasn't involved at that point.
He was seen running from the venue at high speed and pushing over the victim while his back was turned, sending him airborne, before landing several blows to his head while he was on the ground.
Balta appeared to throw another punch to Mr Washbrook's head as he walked off.
He presented to police and admitted to throwing three to four punches.
And less than grievous bodily harm.Assault occaisoning actual bodily harm*
Common assault is a lesser charge.
It’s unlikely he will receive a custodial sentence. As he’s a first time offender with no criminal record (I assume).
Will be interesting if it’s deemed bad enough for a community corrections order (essentially supervised bail and community service) or an intensive corrections order (ankle bracelet and what amounts to house arrest etc)
He will probably get away with a CRO (old good behavior bond) but I reckon he’s sacked by the AFL for a CCO or ICO or above.
It’s probably borderline between a CRO and CCO.
3% of first time offenders for the charge are sentenced to a custodial term (jail).
Maximum sentence from a local court, which he was heard in, is 2 years or $5500. The average custodial sentence is 9 months for it.
Can he serve a community corrections order if he lives interstate? Will be interesting if it’s deemed bad enough for a community corrections order (essentially supervised bail and community service) or an intensive corrections order (ankle bracelet and what amounts to house arrest etc)

And less than grievous bodily harm.
He'll get a fine, no chance he is sacked.
Can he serve a community corrections order if he lives interstate?
Of course he can be sacked.
29% of offenders found guilty of this crime are given custodial jail time. It’s a serious crime.
He’s a first time offender, so he won’t.
If he’s on a community corrections order where he has to report to community corrections regularly, has a curfew, community service, anger management order, banning order from Mulwala etc I think there’s a high possibility he’s still sacked.
How do you play night games with a curfew?
Grevious bodily harm is one of the most serious non-homicide charges there is in the NSW legal system. You trumpeting that like it’s alright because it’s not that, is way off.
It’s like saying - it’s all good, it’s only sexual assault, not aggravated sexual assault causing grievous bodily harm (which carries the same sentencing guidelines as grievous bodily harm)
Push a bloke over, punch him in the head while he's on the ground, then punch him in the face while he's on his knees defenseless. What a dickhead.
He's not going to jail for that.
Yeah it's a shithouse act and I thought he was better than that.Push a bloke over, punch him in the head while he's on the ground, then punch him in the face while he's on his knees defenseless.
He most certainly should be going to gaol for that.
Shit bloke and shouldn't be out in the community until he does his time.
Thoughts?I'm deflecting? You told me he was going to Jail and I bet that he wouldn't.
It seems you've backed down now given you aren't doubling down on your claim, which is good.
Yeah it's a shithouse act and I thought he was better than that.
Not jail worthy though.

Not jail worthy though.
I was responding to a post saying it was jail worthy, so yeah, it is exactly the point.Again, not the point.
If he’s on supervised bail following an indictable conviction, is he still allowed to play?
What precedent is there for that?
I was responding to a post saying it was jail worthy, so yeah, it is exactly the point.
Stop quoting me.
Because it's just not. Have you seen the shit people get away with these days? This pales in comparison. How is it not jail worthy? He sent the poor ****er flying when he wasn't even engaged in the argument an then belted him while he was on the ground.
Good to see Richmond supporters defending pure thuggery but is anyone surprised?
It's probably all they knew growing up.
Who is defending that footage? I haven't seen one post defending it?Good to see Richmond supporters defending pure thuggery but is anyone surprised?

Tends to be how it works on Bigfooty
Player from Club you support does something bad “nah, it was justified, not that bad, other guy deserved it”
Player from Club you hate does the same thing “Hang, draw and quarter them, strip the club off draft picks then relegate them to the vfl”
Not defending what Noah did btw, but if he was a wce player, there would be eagles fans defending him instead
