I though it was pretty clear. The room done in H5 wasn't a bathroom, which makes a difference. The waterproofer did the room without the pre-inspection and unknown to E&L. The (now sacked) builder had pictures of the room on his phone in various stages of completion. So they decided to look at the photos and saw that the room was compliant and passed it. However, if it had of been a bathroom that would never had been accepted the and waterproofing would had to have been removed (which has happened before).Yeah massive inconsistency. Ash is building a bathroom, so pictures are not acceptable. It's a different scenario and it was explained to him that they can't do that for a bathroom. They told him E&L's situation was different. He wouldn't believe it because all he could think was E&L were getting special treatment.
Now, I agree, Keith & Dan were being lenient to E&L in this case, but only because it wasn't a bathroom.

I thought Ash was making a mountain out of a molehill there to justify his own circumstances.However the key point here is the water proofer that was used was an experienced guy with plenty of block experience and thst is a key piece of Information here.
