They were specified because if you want to give a significant punishment to clubs you have to make sure your own rules are very clear on what an offence is and what the punishment for that offence is. Otherwise its very likely any punishment you give will be overturned in the courts.They were specified because they had precedents. This was unprecedented. That doesn't make applying reasonable and fair penalties in this case impossible and not worth trying. End of the day the clubs got off lightly because money talks and that's the start and end of it.
You can't just pluck a 40 point penalty from up your arse and apply it just because it seems like the right thing to do.
