So over this... dragging Jessie White, Joyce and now VB through it....

The club has said all along that we're guilty of a gentleman's agreement to assist KT to return to a club in his home state... and until Monday.... that's as much as I believe. IMO all the media beat-ups and KT lawyer chest beating and sympathy seeking smells strongly of team KT tactics to divert from the actual mistake of AFC agreeing to help the s***; and KT trying to enforce the agreement with a trade to his non-home state club of choice - $ydney.

Yes, but this has become its own beast, and if you leave a vacuum it will be filled.
I still think we should character assassinate Tippett, find his Ex, get her story out, Get his housemates on board, Team Mates can tell stories of him skipping rounds!
 
I'm hoping for a 3rd Letter, this time from Trigg to Tippett mobs,

Dear Mr Tippett,

John Reid has recently shown me the letter that he signed regarding your future trade and payments.
As they are clearly in breach of AFL rules we will be unable to meet their requirements.
We will endeavour to get you home to the club of your choice at the end of the agreement.
If you wish to revoke your extension, we understand and are happy to revert to your old contract.

Any chance this could drag out past the 22 Nov draft day? Sounds like there is alot to discuss on Monday and I cant see us hearing any outcome until at least Tuesday.

How does everyone else see this panning out?

AFC calling 11 witnesses and XXE allowed. 3 x QC's.

I would be very surprised if this resolves in 2 days although depends how long they sit for each day.

IMO it's a certainty to drag out to the Tuesday, given that there are the very best silks representing each of the AFL, Adelaide and its employees, Tippett etc and that we will either be disputing the severity of the charges and even the charges themselves in some cases.

The AFL will obviously be trying to finish it by Tuesday night at the very latest, but I guess if all the Commissioners are still available, they could spill into the Wednesday if it became absolutely necessary.

I just can't see them letting it drag out past the Tuesday, let alone the Wednesday, though.

I am pretty sure if we appeal the findings, if they come down tuesday, it would allow us to particapate in this draft and maybe affect next year rather than this year, we can still get BK.
 
That's what people are saying and would explain why we haven't responded to any of Caro's and EQ's allegations.
One of the emails to members or tweets said that our lawyer told us to keep quiet.
 
so Nick Joyce loses his contract if we can't participate in this year's draft?

Can he sue the AFL, it is them that demand Tip stay on our list.


I dont understand why he has to stay on our list, is it a punishment???

No different to Ben Jacobs, who is no longer on Port's list or Hayden Jolly who also is not on GC's list.

My thoughts exactly some pretty important people called in for this and natural justice means everyone must be given a fair go. All the heavy hitters will be throwing their weight round trying to come out glorious to satisfy the media hype they were right all along.
 
Even if we get taken out of this year's draft, we'll have a rookie selection available. Joyce can be taken then.

As for the VB denial, brilliant to finally see some strong words from someone in our own defence. I guess it wasn't possible in the Tippett case since the Tippett camp is accusing the Crows of inducing them and we've been gagged by the AFL.

Let's not jump too quickly to conclusions, though. VB and his manager might believe everything is above board, but it's possible that a clerical error has been made somewhere.

At least it's given us something to be hopeful about! As I said earlier, in a normal situation we'd likely have waited for the response before assuming that we were in the wrong, but the whole Tippett saga has made that kind of prudence seem naive.

I know I have posted this previously so at risk of being repetitive let me just say again....Our Counsel is an aggressive, disruptive, combative so and so. Approximately 15 mins from him is about all it will take to cause discomfort for all. If he has a client facing serious sanctions I just cant see how these proceedings will be a tick and flick exercise as the AFL would dearly love.

Anyway Im speculating macca but its my best guess that we will be lucky to the end by Tuesday evening.

Of course there is always the propsect of the AFC putting a leash on him ....

Approximately 15 mins from him is about all it will take to cause discomfort for all. If he has a client facing serious sanctions I just cant see how these proceedings will be a tick and flick exercise as the AFL would dearly love.

Of course there is always the propsect of the AFC putting a leash on him ....

Also, the AFL would know if they don't do things properly then they may face some legal action back. I think it's a good move.

Peter, for those of us who have no idea on legal matters can you give us some idea how this would proceed.

Do the commissioners ask questions? Are witnesses cross examined ? Do the commission have to be unanimous on the question of guilt? How do they present the information gained from the investigation?

Is it anything like what we watch on tv

Even with the national draft, I could be wrong, but I doubt we'd get our picks entirely removed. I mean, if we were six spots short on the list, the AFL wouldn't just make us going into next season with 6 holes. They might make it so our six selections come after every other club has finished with theirs, but that's all.

Otherwise it would be a pointlessly cruel exercise to have us kick out Joyce in order to clear up enough space to have the necessary required number of selections, only to then not give us any selections and leave a hole on the list. No way the AFLPA would stand for that.


In our case, we're three spots short (two once Crouch is brought on) so I'm confident we'll be given at least that many picks in the draft. Again, they might instigate it so that we only get to make a selection once everyone else has passed, but that would be as harsh as it would get.

one of the earlier posts listing prior sanctions mentioned Sydney (I think) having to play a couple of players short for the next season. Would be overly harsh I agree.

This time the room will be bristling with QC's who will ensure that there is no kangaroo court and that they will have to prove that their is actually an offence, not the other way around.

Again, because of the high profile of this matter, I believe that any benefit of doubt must be granted to us and Tippett, not the AFL, or they will risk legal challenges by either party.

Surely this will put pressure on the Commissioners to give a fair penalty that fits the crimes, not just some savage penalty to be used as an example for the future.

I hope to god he's everything you describe and more. This is exactley the tyoe of bloke I would want fighting for me in the courts.

Will be very interesting post Monday. This thread is starting to rival the "Game of Thrones" series.

I hear you macca but we are not in a court, the Commissioners are not judges, the rules may not stand up to intense scrutiny, and I'm not sure what our appeal rights are.
