What are those rules though PJ? The rules will be whatever the Commission decides the rules will be.

They have to comply with overriding principles of procedural fairness and natural justice.
 
Assuming Kurt Tippett is guilty, you would be right, they will bully him. They won't want him challenging them in court. However, I'm not 100% convinced he is entirely guilty but feel the AFL will be very friendly towards him. However, if he is found to be guilty and he does take them to court; the AFL will apply plenty of pressure.

The club and manager should have known better not to take this path and Kurt Tippett's manager should have done a much better job at explaining the legal clauses and ground to his client. So Kurt Tippett should get of scott free but the AFL like most other professional sports isn't a real world environment.

But overall, I have no idea what will happen. I doubt the Adelaide Crows will gain anything out of this but a whole lot of pain and somewhere deep down can see Kurt Tippett ending up in Sydney.

That's not really fair but it's the reality of the AFL. Heck, even Ben Cousins wasn't dealt with that harshly. It's a very player friendly league.

Also, in answer to your other question, nothing would make 90% of this board happier, than if Trigg was forced to resign.

Crows will get off. Slap on the wrist/warning. The media have raised the spinnaker and really run with this.
But what else are they gonna do? Controversy, gossip, innuendo.
This is paradise for the likes of Caro and Rucci.
I must say, I've had great fun teasing all my crow buddies about this,
but it's gonna amount to nothing.

How about, guilty by association.

I imagine he put a whole lot trust in his management to tell him the truth and outline the integral details of the deal. If that didn't happen, he could be not entirely guilty and will learn a very valuable lesson.

I don't have any knowledge of Kurt Tippett level of education so I can not comment on what he understands or not but If this case was here in the states, I'd suggest the player was innocent as he didn't understand (lack of education) what was happening and manager did not revealing all the information.

Once again, not the same circumstances but I'd suggest yo go and read Gary Ablett senior book and find out how little he knew about the day to day dealing of his contract, how much money he needed to live and get by. Living in that fishbowl environment is a very accurate and fair comment to be made. I don't know how it is in Adelaide but some players live a very sheltered life.
 
As I think back I'm reminded of a case many years ago when Eddo was making his way. Public sector admin hearing in a makeshift hearing room. It was a 40 degree day. The makeshift hearing area was air conditioned however the only waiting area for witnesses was outside. Eddo was defending. There were 3 prosecution witnesses in suits who gave their evidence and Eddo knew he did not want to cross examine any of them. However he indicated that he might need to and refused to allow their release. Those 3 were then made to wait in the heat for 2 hours until it became a health issue and he finally relented and said he would not need them. He just kinda goes that extra step if you get my drift.

I agree, wish it was on TV!!!!

Peter J, please stop with the teasing! You are exciting me, giving me hope that we actually have some decent chance of getting of lightly! This lawyer sounds impressive. At least I can feel comforted in knowing we tried our best, getting the best defence lawyer we could.
 
Personally I feel a bit dirty knowing that the AFC has employed the same person Eugene McGee. I know laywers are just doing their job, and he obviously does his very well. However, if I was a laywer I don't know if my conscience would have let me represent someone who (to me at least) was guilty and trying to get out of killing someone via legal technicalities.
You would neve be a lawyer (or a politician) as you have a conscience ;) ... but I get what you mean as McGee should have got jail time.
 
It's really interesting to see that the two sides have adopted opposite strategies.

Tippett camp: making their case in the media, mouthing vague threats of further legal action, trying to intimidate the AFL by suggesting they may not accept 'the verdict' and could take it to court.

AFC: openly stated they will accept the AFL's verdict.

Which will prove to be the best strategy?


(I think the AFL will be intimidated by Tippett's approach and go light on him, and throw the book at us.....because they can. Hope I am wrong.)

I hope not Boffo, he is already a brat, to give in to him will send a message that the AFL can be intimidated even if you are in the wrong. I hope they smash him like a dropped balfours
 
Easy for you to say as its does not affect you. If you were in trouble Im sure you would want someone going the extra metre. Im surprised you would question this given the way your club used to play its football.
On a football field perhaps - but not in the general pursuit of life. I still think he's a prick. I was involved in the McGee case and have hated everyone who acted on his behalf in any form ever since. Probably why my ears pricked up when I heard his name mentioned. When you are guilty he seems like the man to turn to though so I think the AFC got this one right. On this form I'm surprised they didn't enlist Michael Abbott as well...

Thought some insight may be of interest. I agree that it is good to know we wont be shafted and if we get the book thrown at us then it will be appropriate.

It still seems pretty clear to me that we are only being fed one side of the story and we all know there is nearly always two sides to any story. Im sure AFC/Trigg are bursting to respond in the right forum. If it plays out as Caro predicts then we take our whack and Trigg goes.

However until the final siren sounds anything and everything remains in play.

When I was deciding what I wanted to be in life I considered, briefly, law. This is why I never became a lawyer:

I said to myself: can I defend someone who I know is guilty? The answer was, no.

I said to myself: can I prosecute someone who I know is innocent? The answer was, no.

These are simple moral questions, most of us on BF would say ‘no’ to both without hesitation.

All parties in this mess have hired guys who would say 'yes' to both without hesitation...It is going to get very, very, ugly.
 
Wow just wow ..... Even 22,000 posts cannot embody how unbelievable this whole Tippet thing has become.

On the one hand I think Tippet should be thrown into the roughest part of Adelaide with nothing but a feather duster and see how he holds up.

From an Adelaide supporter's perspective I would be gutted that the people at my club steering the ship could not see the huge friggen iceberg. I mean seriously as a Carlton supporter I don't want to see anyone hit like we were but geez why try to keep a player that has his heart set on leaving .... No good has ever come out of retaining said players.

But what I really hate is the AFL with them everything is cool until the media blows it up and then they bring out the big stick. Way too much underhanded crap from them helping the expansion teams at the cost of clubs that made the competition what it is today.

Personally I'd like to see the CROWS get off Scott free and Tiprat get shafted with a pineapple (what a complete tosser)

Now I never in my life thought I could utter these words but I actually feel for Adelaide supporters at the moment.

If we assume that we are going to loose draft picks has anyone got any idea how they work that out.

When Carlton got penalized they lost picks 1,2,31 and 34 in the first year. Plus all their picks the following year. Our first pick is 20 then 54, 83 so if we were punished by removing our first 4 picks it would not be the same punishment as Carlton received.

Do the afl take into account what position your picks are or just what round they are in. If it is the latter then that would be great for us.

I am interested in seeing how the AFL view the whole underwriting of the 3rd party deals, considering the Tom $cully 'my Dad's on $100k as a recruiter' problem was swiftly ignored after GWS agreed to include his wage in the salary cap. The underwriting is almost the same thing considering the Crows would still have been within the salary cap from all reports.

Of course that is just one of the things we did wrong. :(
