Scandal Tom Silvagni convicted of rape

The guys life is going to be extremely hard after he comes out. He would be lucky to get a job at Woolworths stacking shelves. This is an extremely public case and no employer would take a risk on a high profile sex offender any time soon.

The sentence I feel is about right without knowing the details and evidence etc

Spare me I couldn't give a toss how 'hard' his life is after he comes out.

How do you recon the victims life is? Or has been for the best part of 2 plus years?

When it comes to rehabilitation, maintainimg familiy ties is seen as paramount.

If it's easier to maintain those ties by being somwehere like Barwon, which is much closer, then he'll likely end up there, if that's what they petition for.

That's fair I was just going off the guy who was on the podcast someone linked a few days ago.

Can't remember his name but he has covered the case.

Did the judge say whether or not he’ll need to be on the Sex Offender Register?

Offences Against Adults: Rape against an adult is generally a "Class 3" offence. In these cases, registration is at the court's discretion. The court must be satisfied beyond reasonable doubt that the offender poses a risk to the sexual safety of the community to order registration.

Yes it's one of the things they look at, part of the rehabilitation and counselling to address the issues that lead to the offence.

He could easily just tell them he's learnt blah blah to meet the requirements, it's all done in custody anyway.

Unless it's changed in the last decade, he will be assessed before he is placed into a prison. Along with that assessment, there will be a list of non-negotiable offender courses he will need to do before he will be eligible for parole, there will also be other voluntary course recommended.

On arrival at prison, he will be allocated to a staff member. He will have a sit down meeting/interview with the staff member and they will go through all of this.

Generally the crook is only interested in the bare minimum requirements for parole, all the other recommendations they will tell you to bang it up your arse.

As a newbie, he will probably agree to do everything.

Unless stated it's usually automatic in these cases so assume it's a yes and good we need more of these people held accountable

Be interesting to see how he responds to rehabilitation & counselling & if it's perceived as being successful, if he continues to maintain his innocence.

He won't be getting parole unless he takes responsibility for his actions, by all means maintain your innocence and serve the 6 years and a bit

No one is down playing the trauma or punishment the victim has recieved.

Sort of are if the main thought is the perpetrator. We shouldn't care one single bit about a bloke who has been convicted of these offences and still hasn't taken any ownership. spare me how 'hard' it may be for him and it won't because the family is lets say well off okay.

The main thing should always be the victim nothing more or less

That's why I say interesting to see what he says going forward.

Finally take responsibility or maintain his innocence?

He will need to take responsibility and be a man. Owning up you have made a terrible mistake, not that I call it that but whatever. Make amends do the programs and etc.

.and he will have had to have done all the offender courses stipulated from the MAP before he gets ton where he's going.

Maybe he'll end up in Barwon where it will be easier to segregate him as a high profile prisoner. Or they could chuck him in Hoya unit with the rapists and kiddie fiddlers, he could swap stories about the good times with Peter Dupas, John Sharpe or maybe even a real rockstar like Leslie Camilleri.

Used to be friends with Sharpie before he did that thing he did, and was wondering where he was living for some time. Interesting.

No, no I’m not. We are discussing the sentence in a Tom Silvangi thread dedicated to the case. I’m not going to write “He deserves 25 years bal blah “ when it’s simply not realistic with current juridical system

So if he owned it, was remorseful the whole time and admitted it, what would have happened?
Gut feel that if he owned it, spared the victim a trial and having to be cross examined then his sentence would have been a little lighter but is non parole would have had a significant cut as his prospects for rehabilitation would be better.

Going the route he did just makes him a dead set campaigner who is lucky he comes from money

I could be wrong but I thought I heard the judge state that there was no application for this to be applied, as per the court's discretion, meaning he won't be on the register.

When I worked there, of all the revolting crooks locked up in that unit, he was genuinely reviled by by all the rest of them.

That takes some doing.

One of the more baffling things is still his girlfriend who was the rape victims friend is still with the scumbag

Needs her head checked
she’s apparently a model

She's an "influencer" and Miss Australia contestant or something similar.

The brands working with her need to cut ties.
