I think it's certainly relevant as to mitigation.

Record alone doesnt set the penalty.

Run up and clock someone high in the huddle for example. It wont matter how good your prior record is in that case. The entire context needs to be taken into account.

No his actions set the penalty. Good bloke or not. There’s nothing that mitigates what he did. However, the tribunal has the discretion to consider his record and having done that apply the penalty accordingly. Everything else is irrelevant.

I'd rather have Gaff pay for the ensuing dental work than worry about getting him an extra week
Although implants are like 6k each it's not really about the money, it's losing your proper teeth for good especially at the front. If someone did that to me I'd want to kill them

Im not talking about 'good bloke'. I am talking about his actions.

He didnt intend to strike Brayshaw high (however he did intend to strike him). He was aiming for his chest (so he intended the strike, and that element is made out) but it's still relevant that he didnt line Brayshaws jaw up and try and rub him out. He swung at his chest, and Brayshaws forward momentum and crouched stance lead to the strike landing high, and hitting with a greater force.

If that's accepted, it should be slightly mitigating. He'll still get multiple weeks, but not some kind of 'line in the sand' punishment.

Its certainly different context to Lethal walking up behind someone in a huddle and clocking them in the jaw (aiming for said jaw) as they have their back to him (for example).

Well I’d find it hard to accept you can mitigate swinging an arm and clenched fist in the general vicinity of a head. If you believe he was aiming for his chest.

Of course they will. Its effectively a work injury and it will definitely be covered like any other injury.
 
Obviously the lawyer is doing his job and trying to make Gaff look like a Saint who has never done anything before and was frustrated due to dirty tactics implemented by Freo throughout the game. They are just trying to have the penalty reduced as much as possible

I actually do think he was aiming for the chest. Brayshaw was running past his left side after blocking his run, and was crouched with his head down and with forward momentum.

I honestly reckon Gaff was surprised he hit him on the point of the chin.

Not condoning the action, but It would be different if Gaff swung directly at his jaw, aiming for the head.

It’s called a tag and happens every game without the tagger having his lights punched out
