Very interesting development, I dare say this decision may set precedent for other potential actions for former players whose career's have been negligently cut short (hence why I've posted this on the main board).

One of the most disappointing stories in recent memory, Egan was going to be one fantastic player for the Cats, however tragically injured himself in the last round of the 2007 home and away season and never played again, missing out on all three of the Cat's premierships.

Having read that "The Mission" book, he tried to train and push to get back for the grand final after being diagnosed with a navicular fracture, similar injury to what Hird had in the 90's amongst others. Utter insanity. If anyone at the club told him that was a good idea, that's crazy.

Interesting and potentially terrifying. Find it hard to believe, as should Matthew, that Geelong didn't have just as much motivation to get him fit & rehabilitated as he himself had.

I would like to know what his negligent treatment claim is. He would have agreed and signed off on all treatments he received

No doubt that its likely that the claim may be very complex, there must at least be a prima facie case behind his claim for it to even reach the Supreme Court.

This decision may even have some persuasive precedent on the outcome of Essendon Football Club players regarding their (potential) negligent mistreatment by the club. Could anyone think back to a time where a player or players have brought a civil claim against their former club to court? This could easily pave the way for the new 'head trauma era' where past players who suffer brain damage could make a claim against the AFL for their failure to adequately protect the head, especially pre-2005.

Former Fremantle ruckman Daniel Gilmore is claiming club negligence contributed to his career-ending head injury.

The delisted ruckman will allege he was incorrectly passed fit to play by club doctors after a heavy hit in 2008.

Gilmore, now 28, has since endured migraines, dizzy spells and lethargy. He was cut by the club at the end of the 2009 season."

How about people take responsibility for their own decisions. He could easily have said that he is not fit to play. This s**t pisses me off to no end. He knew he wasn't 100% but he chose to play anyway, doctors can only know so much about how well a player is, ultimately it is the player who should be making that call if the doctor says he is right to go.

Pretty sure Mark Blackney is still used by most of the clubs. Think he did Mitch Clark's foot which possibly ended ok just all the drama around it ruined his soft tissues and in turn contributed to his depression.

And Chris Bradshaw is still the Geelong doctor and still highly regarded.

It's possible that one or both of them made a mistake or mistakes in treating Egan and so here we are at litigation.

Aaron Keating sued the crows from memory.

A FORMER Adelaide Crows footballer was injured for life after being injected with painkillers and told to get back out on the ground, court documents claim.
Aaron Keating is suing the club and seeking $40,000 in damages over his pelvis injury.

Keating, who played in the 1997 Crows premiership side, says his pelvis fractured after team doctor Brian Sando injected him with anaesthetic, told him to "warm up" and return to the field following a rucking collision that season.

His statement of claim says he followed Dr Sando's instructions "by jogging on the spot and lifting my knees".

"On about the third step of this routine, I heard a loud cracking noise in my hip which I felt through my body, causing me to fall to the floor," it says.

In a document lodged with the Adelaide Magistrates Court, the 31-year old says he is suing because he has learned the injury is permanent, degenerative, and will worse

Whatever it takes…

Also Andrew Browne sued Freo.

Daniel Gilmore is now a chiropractor in Sydney I believe.

Luke O'Sullivan or Adrian Whitehead (or both I can't remember whom exactly) also sued Carlton for similar reasons.

Its easy to be critical of players in these instances, but in many cases, injuries sustained in their football adversely affected their capacity for work/income after their AFL careers ended.
