Please play nice in this thread:
  • No names until they are officially released
  • No judgments on the players under investigation
  • No victim blaming

They may have extra room in their salary cap after the recent events....
She went to the police the same day if her drink was spiked there is a 50/50 chance it comes up in a blood test
If that happens there is the further risk other players who were in the house may have lied to police about her behaviour in the morning this could be a huge disaster

How long will the blood tests take?

I don't know but the case will be a slow process they will bring them in for questioning and then charges may come a couple weeks later.

Rape cases are balls everyone wants CSI shit and these guys will have the best lawyers

Bruise can't be dated and the photos taken at the station will probably just be red marks when they photograph them

If they used a party drug the lawyer will argue it was taken willingly and a victims memory is clouded even without drugs.

If its a date rape drug it doesn't stay in the system for very long and can be hard to detect

Lawyers jump around the timeline and look for any error between recorded statements it is a pretty nasty experience

If the rape kit finds semen from other people they will try and paint her as having low morals

thats a depressing post.

I did jury duty couple years back could of been excused but thought it would be intresting

The problem is that the people that should be in a jury are all excused or not allowed I got my work to write a letter after the first trial to be excused

Always remember that you are being judged by people too dumb to get out of jury duty!

What can you say about a publication that rates a possible Hawthorn trade as more newsworthy than an alleged rape involving Hawthorn players? Do you reckon the Milne case would have been bumped down the page with news we were trading for Fergus Watts?

Juries are wonderful. You'd be surprised how fair they actually are.

Criminal lawyers on both sides - prosecution and defence - generally agree that juries get it right. I'm a fan of going one step further and giving juries power over sentencing (research shows that people make very intelligent decisions about sentencing - decisions that would on occasion outrage our good friends in the tabloid media).

I would like to see nurses, doctors, social workers, and other excused professions in juries its difficult when the members only reference is TV and Movies

Maybe I was in a bad jury almost certain one member had to use his notepad to cover his erection when the girl was being questioned by the defense

The Hawks seem to be getting off lightly in the media over the player(s) involved in a serious incident, compared to Milne having his name and reputation splashed all over the media for years.

From memory Butterss came out years later and said they'd made a mistake in releasing Milne and Montagnas' names. If I was Hawthorn I'd certainly be keeping the names under wraps until any charges are laid.

Had the club not released the names, I'm pretty sure those within the police who were sympathetic to a couple of bigger clubs than us would have slipped the names out the back door to the press...so I'm told

Was thinking the exact same thing.

Even Majak has had it pretty easy compared to Milne. Whether or not he was guilty, the media ruined his life.

Collingwood got less heat over their alleged sexual assault than we got from the school girl saga.
The thing that really shitted me off about the schoolgirl thing was there was never an apology when it all turned out to be a lie. Caro got on her high horse and got mileage at the expense of our club, but they all went to ground with no apologies.
I hope hawthorn cop it big time.
Though k qualify this by saying I hope the young lady is ok and her health should be what matters

That's what I reckon. It takes care of ridiculous discrepancies where there are political pressures and agendas pushed onto judges and magistrates. You can truly sum up an individuals case that way. There are some very jaded judges who will gladly preside over cases that have been deliberately interfered with from politicians or media.

Interesting thing is when that's been trialled juries are often lighter on sentence than the sentences most complained about.

Problem is that most people are unaware of bias and so the defendants appearance affects the sentencing.

I would like an IQ test for jury members and half day briefing on the idea of reasonable doubt and I know it is subjective but still

Rather face a panel of judges then a jury if I was innocent

Interesting use of language by the media outlets.

The ABC:
The Seven Network reported on Friday that two Hawthorn players were under police investigation after a 19-year-old woman alleged she was r*ped in the back of a taxi and then at a property in Ashwood, after meeting the AFL players at a bar.

The Age:
A 19-year-old woman reportedly contacted Box Hill police station regarding an incident on October 9, six days after the club's grand final win.

AAP:

The Herald-Sun / The Australian:
TWO Hawthorn players have been interviewed by police about the night a teenage girl has alleged she was r*ped.

The 19-year-old girl has claimed a Hawks premiership winner and asquad member r*ped her after they all met at Richmond's Mountain View Hotel onOctober 8 — five days after the Hawthorn's historic three-peat.

Last I checked, a 19-year-old female was a "girl" only in the colloquial sense.

Nothing will take away from Milne suffered by the media. It was even mentioned again in the HeraldSun by suzie obrian I think in regards to footballs bad boys
