My tenants have a one year lease on my investment property which ends early Feb 2003. I am selling my house at the moment and need somewhere else to live. Can i kick them out early if i give enough notice? Or can they dig their heels in and stay until the lease ends?
 
They have the right to stay until the lease runs out, put the shoe on the other foot, what would you do if they came to you & said, hey we are moving out in a couple of weeks, whould you hold them to the lease agreement.

Quite simple really, sorry. ;)

Question 1: Do you intend to sell your investment property?

If not:

- Why would you kick out tennants who are guarunteed to pay rent until Feb? These may be good tennants who may stay there for years.

If so:

- Revert to mantis's post: They have a contract, and they can force you to honour it (and more)

Question 2: Do you intend to move into the investment property in Feb once the tennants leave?

If not:

- rent somewhere else

If so:

- You have to weight up whether it is worth moving into for tax purposes.



At the end of the day, it is a no-brainer. Like Mantis said, there is a contract. You can ask them if they want to move out, but make sure you don't upset them - the laws favour the tennant.

The phrase 'Kick them out' is one of many typical Landlord statements which gives them a reputation in the same league as Car Sales & that being MAGGOTS.

I'll bet your notification to the tenants won't be,
Dear tenants, I need tu kick yuz out, so I can sell me house, no! of course not, it will be the typical suck job, Grrrrrrrrrrrrrr.

I'll bet you only started doing repairs when you decided to cash in your house??.
I hope they squat in it until it's trashed.
