Cousins charges dropped.

The officer that pulled him over did not request the test for drug driving test so the charges have been dropped because of an inability to guarantee a prosecution.

What a load of SHIT
 
Charges dropped for refusing to give a driver drug test. Police believe they won't get a conviction.

Reported on 6pr by Traffic Commissioner of Police. Another police stuff up apparently - charge incorrectly laid by police officer not trained to do test

The AFL officially has a problem...

BREAKING NEWS: WA POLICE have received legal advice that the charge laid against Ben Cousins of Refusing a Driver Assessment should be discontinued.
As a result a notice of discontinuance will be lodged in the Perth Magistrates Court later today.

The legal advice was provided after an internal review was ordered by Commissioner Karl O’Callaghan into the charging of Ben Cousins with the illegal possession of the prescription only drug diazepam, which in WA is illegal in liquid form but not in tablet form, on October 16.

The review identified some issues with how the driver assessment was conducted with Ben Cousins.

Mr Cousins was the first driver in WA to be charged under new drug driver laws, which came into affect on October 12 this year.

After close legal scrutiny of the legislation it appears that the driver assessment should be conducted by the officer who observed the motorist driving the vehicle.

In this case, because it was new legislation, the detectives who stopped Mr Cousins thought it best to take him to Traffic Headquarters for advice and to be processed.

Consequently, even though Mr Cousins declined to participate in a driver assessment, the traffic officer who attempted the driver assessment had not observed Mr Cousins driving, and therefore was not the appropriate person to conduct the assessment.

Because this is the first time this charge has been laid Police will now hold talks with the Minister for Police about ways of simplifying the administration of a driver assessment so that any police officer can do the assessment.

no they dont, they still have a litany of breaches, including the 5 day bender in LA. They can say they had a pre-emptive strike

5 day bender as a private citizen...take that to court and see how long it lasts! I got no problem with him being sacked, but I do think the AFL will have some real issues now.

I couldn't care less if you badly influence our players, they're crap anyway.

So, you are trying to get me to believe they pulled him over on suspicion of possessing drugs, detained him for all that time, and never even asked him to be tested? That has to be the greatest load of BS I''ve ever heard.
apparently the officer who noticed his erratic behaviour was not the one who signed off on him refusing the drug test.
 
Very nice police work.

It seems everybody knows what Cousins is doing but nobody can actually prove it.

The AFL now has to find a way to ban Cousins without a great deal of actual evidence to support such an action.

Ben Cousins still refused to do a drug test, the technicallity won't matter to the AFL. Just the fact that he refused one would have easily been enough with the rewritten contract.

Cousins has been rumoured to be taking drugs for many years, he is in the spotlight, had police run ins, been associated with shady characters...yet the police have NEVER had any solid evidence which would allow them to take him to court.



What a fine police force we have :rolleyes:
 
West Coast and the AFL would be pissed, lawsuit definitely on the way.
He was effectively sacked for.....well nothing.
How many times do i have to say this? He will not bring legal action as the ramifications that any legal inquest brings will hurt him and his associates more than anything.
