Tablets: could be trouble

In what might constitute one of the stupidest crimes of the year, Nathan Kevin Davis, 19, of Boronia Heights, pleaded guilty to drug possession and was fined $200 in the Brisbane Magistrate's Court yesterday.

The court was told Davis turned up to the Fortitude Valley police beat office about 5.30pm on Saturday and slapped half a tablet on the counter.

He asked for the officers' professional opinion about whether the tablet was a drug, and wasn't fazed by the suspicious looks he got in return.

Davis admitted he bought the whole tablet for $35 from a man in the Valley, but seemed to be having doubts about the salesman's credentials and complained that he had already taken half the tablet without an effect.

In a case that led to stifled giggles throughout the courtroom, defence lawyer Peter Delibaltas had little to counter the police version of events.

"Obviously, the other half of the tablet had had an effect," he said.

"If he hadn't put the other half on the counter, he wouldn't be here today."

Magistrate Jim Herlihy had nothing to say to Davis before fining him $200.

No conviction was recorded."
 
Actually, what he did was not stupid at all. He confessed to his crime, was fined $200 and no conviction was placed. Smart thing to do... considering that if he got caught with more of those drugs and tried to cover it up by refusing his crime/hding the drugs, he certainly would get more than a slap on the wrist.

Perhaps Consumer Affairs or the Office of Fair Trading could have helped him. Or the drug dealing Ombudsman perhaps. Fair to say the drug did have an effect. It fried his last brain cell.

WWWWWHHHHHHHHAAAAAAAATTTTTTTT. Are you the guy Thrawn, what drug are you on man. Nah he's not stupid, he may of been caught anyway, then it would of been worse. Imagine if all the crims thought that way, god we'd have an interesting but VERY BLOODY BENT society.

Obviously, he should've avoided the crime in the first place. But that's not the case in this story... he certainly took the smarter route if you ask me (considering the circumstances). As I said, if you did something like this, better to confess and get a slap on the wrist than run and get caught with a voice of denial. Hypothetically speaking, of course. I'm not condoning his actions, merely saying that he's not as dumb as first thought!

He got away with a $200 fine, and no conviction under his name. Good choice to confess if you were in that situation.
 
Did they analyse the pill?

Because if he didn't get an effect from the first half then there's a chance that it didn't contain any illegal substances so they shouldn't be able to prosecute.

If they did test it & it did then perhaps in future he'll make sure that he pops the whole thing in one go & jumps around a bit to get the old blod pumping & he should be alright.


Actually this does open up a serious debate about the decriminalisation of all recreational drugs, so that people get pure, unadulturated products, without having to be ripped off by or poisened by unscrupulous types.

Also you'd cut a huge amount of all crime away in one go.

Of course society would never let it happen, to many the idea that some people would like to explore the possibilities of their mind or that some people don't find life that fullfilling & like to escape is unpalatable.

It throws into doubt their whole existance & makes them question why everybody isn't as happy & content with 21st century living as they are.

Personally I'm a libertarian, I'm behind the rights of individuals to do with their lives what they please as long as it doesn't directly harm others.

Indigenous peoples have been taking mind altering substances for thousands of years but here & now society likes to dictate which ones it deems acceptable & which it doesn't.

F*** em I say.

What? He would never have been caught, had he not showed up to the pen and put the pill on the counter. This guy is the very definition of stupid.
 
Yeah Thrawn, I agree with Milko

He was in no danger of being caught. If he killed someone or hurt someone, and owned up, then yes I see where you are coming from, but the bloke bought 1 pill, and popped half. If had of popped the lot, and went home and got over it, then there was no chance of him being caught.

I'm having trouble deciding who is the bigger idiot - you or him?

He certainly WOULD NOT have got more than a slap on the wrist. (unless he was walking around with 100s of the things)

I've heard the odd story like this before, although I don't know how true they are........the guy who's growing weed in his back shed and gets ripped off while he's at work, and then rings the police to tell them........ :p
 
Drug dealer I knew at ANU, in the early 70s, was ripped-off by two gun-wielding bandits. He reported this to the police and the two were subsequently convicted and jailed for armed robbery. He wasn't charged with any offence. Weird.

Only in Canberra though. Don't try this at home.

Ofcourse it was stupid! The chances of him been caught if he didn't walk into the cop shop were super slim to none, as he only had that one tablet on him.

It wasn't smart at all, I don't even think it would be possible to be caught. Could a sniffer dog even pick up the scent of one tablet (actually half a tablet since he took one half)? And if it could, what are the odds of running into a policeman with one.

The courts have bigger things to deal with even if he did get caught, how much of a sentence would you expect for single tablet?

I was hypothetically talking about if he had got caught with a stack of those pills, and then trying to hide them or refusing to having possession of drugs. Not one singe pill! Your second last sentence sums that up (you misread my post... I DID mention what you said), which was what I was actually talkin' about! I said "considering if he was caught with more of those drugs"... not "just one pill". And please, don't exaggerate my post! ;)

For god's sake, I drew up a hypothetical situation sayng that had he have been caught with more of those pills (a substancial amount), he would get more than a slap on the wrist! It is smarter to confess rather than to not when assuming that he'll get caught with a stackload of those pills and trying to hide them and refuse his crime! And then I get accused of being an idiot! And for what? I probably didn't phrase it probably... maybe I should've said it was "the smarter thing to do", assuming that he'll get caught with plenty more and refuse/hide his crime!

Sheesh... please, before calling me an idiot, please read my post carefully and you'll see that it did not apply to only just the one pill, but a stackload of 'em as well whilst the guy refuses his crime. That hypothetical situation!
