Makes me glad to report that the tribunal found in favour of Gutierrez in his discrimination claim against the club. Club has fallen so far under Ashley in a footballing sense, but more importantly, in a moral sense. Barely recognise the club these days.


Newcastle United face paying hefty compensation after an employment tribunal found they discriminated against Jonas Gutierrez.

The 32-year-old sued his former club alleging disability discrimination after he was diagnosed with testicular cancer in 2013.

Gutierrez was successful in two of his four claims, with the panel agreeing the club stopped him triggering an appearance-based contract clause worth £2m and that he was dropped from the team due to his cancer diagnosis.

But the three-person panel rejected claims he was forced out on loan to Norwich, with experts finding the move was consensual.

Allegations of harassment - that Gutierrez was forced to train with the club’s under 21s - were also unsuccessful.

In a 64-page judgement, the panel found in favour of Gutierrez and cast doubt over the credibility of former United manager Alan Pardew and current managing director Lee Charnley.

The panel found: “Mr Pardew was able to deliver his evidence in a confident, convincing and articulate way. Mr Budworth, in closing submissions, suggested that there was a difference between what was said by Mr Pardew and the way in which he said it. We agree that the detail of what was said was not necessarily as credible as the manner in which the evidence was delivered.”

And Charnley’s failure to recognise Gutierrez as an accomplished international - despite his appearance at the World Cup for Argentina.

The document found that Charnley “appeared to be evasive and lacking in credibility”.

Former head coach John Carver also saw some of his evidence rejected.

Saw that as well, I have a feeling it may be us (seems to be either us or Norwich as he implies a relegated club).

From what I read, some in the Villa hierarchy weren't pleased we poached Clark off them by meeting his release clause. Though reading the comments in the Birmingham Mail, many fans would seem to think we did them a favour!
