Yep, that's the reality of capitalism.

It's also not mutually exclusive to the fact that he's a litigious douchebag that has spent his life intimidating small businesses through the courts.

Thomas has whored the flag out to a commercial flag maker until 2023 as is his commercial right if not his moral responsibility to his people given that his people pay for the flag either directly or indirectly.

That's an odd way of looking at it, especially considering the flag is available for use for free for organisations that serve the indigenous community, at his insistence. It's part of the licensing agreement he's negotiated with WAM.

Why shouldn't he expect to be paid for his work?

Thomas's agreement with WAM has nothing to do with the flag. He has a separate agreement with flags 2000 by which flags 2000 is licensed to manufacture and sell the aboriginal flag. As I understand it the flag must be purchased and I know of no process of gifting flags to aboriginal corporations, not-for-profits, communities or the like. And who, exactly, would bear the costs of that.

Provided Thomas has not licensed the wider use of the design, he could allow the AFL to put it as ground markings for example: and for all I know he may have done that in previous years.

Your essential point is that the whole of Australia has, in effect, sought to appropriate that which belongs to Thomas. Be that as it may, the nation should lament at the present situation.

If we debut Tobin Cox and AFL.com.au don't run with 'Port to expose Cox at AFL level' then everybody involved should be sacked.

A lot of my crows supporting friends and acquaintances on Facebook have come out of the woodwork today. It is seemingly the highlight of their year 👏👏
There are Camry supporters at my work who have not said a single word about football this year...
They felt the need to mention this.
It's actually quite sad. I almost feel sorry for them... almost.

When I said flag, I meant the design, not an actual physical flag.

Of course a physical flag has to be purchased. I'm not sure anyone is complaining about having to buy a flag from a the flag store. The complaints are about not being able to use of the flag design on apparel and merchandise for commercial sale.

The free use applies to the "aboriginal corporations, not-for-profits, communities" who want to use it in their branding and marketing. The designer gives his permission on a case by case basis.

My reading of the situation is that this year was different because the AFL wanted to build the flag design into their Indigenous round logo, which would appear on the guernseys for sale. That's why WAM asked for licensing fees to be paid.

Not the whole of Australia, just those gullible enough to sign a petition without looking into the details behind the claims.

As it stands now, anyone can buy a flag, with proceeds going to the creator, they can wave it at the football, protest marches, parades, etc or just fly it in their front yard.

The only time someone has to pay is if there is a commercial component to the use. This is the same rights mechanism used by artists, musicians, writers, designers, etc.

For example, if the AFL wanted to use Yothu Yindi's Treaty to promote the indigenous round, no one would bat an eyelid if they were asked to pay a license fee for the privilege.

It's no different to the use of the flag design.

Let's just keep our fingers crossed that Hinkley puts Cox on Butts at some stage in the next Showdown.
