No, he doesn't "have any records". Not that he didn't keep them.
ie his lawyers "have them", so he's truthful when he says he doesn't have them.
They need to be more specific and order him that any records pertaining to players, supplement, dosages, suppliers to be handed over. Whether they're in his personal possession or if they're stored elsewhere.
I'm not sure if they're with his lawyers they are classified as "work product" or not. Could a subpoena still be enforced?
