Is it possible for the MRP to temporarily suspend Gaff while they wait for more information? Say the injuries are severe but the docs are not yet able to determine the likely long-term impacts, can the MRP decide that Gaff is going to be suspended anyway and give him maybe 3 weeks and then hold another hearing when the medical assessment advances a little? Then they can decide that the 3 weeks is enough because it all worked out or add on more time as appropriate.

I think the tribunal will have all the information they need
 
Will the WCE lawyer request 5 weeks? Or will they request that he isn't available to return until after the Eagles have played Melbourne next year?

Certain individuals are actively trying to influence the tribunal. Not the same thing.


Nah it was a dangerous shit act ,no need for the media to influence the outcome. Anyone with half a brain can see that. Extreme violent punches any where near the head need to be dealt with severely and 12 weeks seems light on but due to the influence of nuftees like Brown and Carey Gaff will probably get of with 6 to 7.

Not sure they have that capacity. Andrew Dunkley was reported in the 1996 prelim then the Swans took an injunction and his case was heard after the GF and he got 3 weeks. What happens if they suspend Gaff and then by some bizarre circumstance he is cleared? Can of worms.

I think you need to judge the case on the evidence at hand at the time and make a judgement call. Koby Stevens retired recently at 27 from ongoing concussion issues. That could've been as a result of a hit 5 years ago, or an accumulation of hits over the years. Harris Andrews is back playing but is he really fine? You would hope so but with concussion you can't be 100% certain.
 
If they hand out an extreme penalty I can see the club appealing. I mean if Bugg gets 6 and Cameron 5 and the tribunal manages to come up with 12 for Gaff, the club has every right to question how they came to that decision. Gaff will just sit there like a stunned mullet regardless.
Really? I think less likely than most other cases. Any match over 6 weeks doesn't affect West Coast if he's not at the club, And West Coast would be pretty keen to have this issue go away. Trying to argue the penalty is too harsh when the victim is slurping on a straw for 4 weeks is a tough needle to thread.

Well, in that case Gaff would hope the prognosis is well-understood as a "it's all broke up and we're not sure what will happen" won't be good. Unlike concussion where results are indeterminate and still not understood, busted up teeth and bones are a pretty well-known are of human health. Injuries so severe (wait for the inevitable "like a car crash" tweet relayed from a journalist) that they are still uncertain in recovery then Gaff is looking at a very severe punishment, I reckon.

If the defence counsel is worth his salt he will be pushing for a comparable punishment to Bugg/Houli based on precedent.

Pushing for 3 or 4 is unrealistic, and pushing for 8+ he's not really doing his job.

It's really not up to the defence counsel to determine the sentence, though. His job is to present the relevant information to the tribunal to assess. If they don't buy the 'accidental chest punch gone wrong' or 'he's a good guy, really' stuff then Gaff may as well bring his own guillotine.

The reality is if Brayshaw is off solids for a month then he's off solids for a month whether Gaff is playing next week or facing a dawn firing squad. At some point punishment for Gaff ventures into being too much. The club aren't just going to turn around and accept a 5 year ban, for example.

You can spin the PR any which way but West Coast's motivation is getting their player the most lenient punishment on offer. If there was some kind of legal technicality that got the case thrown out, they like every club would take it. People probably don't want to admit that (unless it's about evil WC) but they don't have a defence QC, character witnesses etc. at the hearing for the sake of it.

I think Hall or Mathews are far better comparisons than Houli. Hall got 10. Mathews was de-registered.
