Dr Withers says a specialist has indicated Brayshaw's teeth will likely not be viable, saying they have lost their nerve supply. Brayshaw may now require "extensive dental work" and "possible implants".

Dr Withers says Brayshaw suffered a horizontal fracture through his jaw. He says Brayshaw's teeth were hinged backwards "a couple of centimetres into his mouth".

Gaff will say

'Was targeted all day'.

'He's a mate and I in no way intended for the strike to hit high or that hard. Brayshaws forward motion and crouched stance led to what was supposed to be a chest punch turn into a left hook to his face. That in no way condones what I did, but it is relevant that I was not trying to strike him high'

'Feel awful for what happened, and its totally out of character for me. I am remorseful and my early plea of guilty reflects this'

Shoots down any theory about it not being intentional ay

No the strike was clearly intentional. You cant argue that.

Where he intended to hit him (high, chest, etc) , and the damage he intended to cause/ did cause (low, medium severe etc) is not relevant to the element of 'intent' for the strike. Where the punch landed, and what damage it caused is only relevant to the other two elements of the offence.

It may be relevant in mitigation though.

There wont be any mitigation for anything other than his record

Jesus. No way I would have taken that angle.

Who am I to question a Silk though?
Hard to gauge when you are not there and hearing the evidence. Perhaps the doctor gave evidence in such a way to suggest the jaw was displaced in addition to the teeth (which I understand it wasn't). Need to clear it up for the Tribunal while you still have the witness in the box.

True. Good point.

Id be a bit careful not to give the impression that the damage 'wasnt that bad' though. That wouldn't end well.

have a load of the west coast supporters now mad that "his teeth were caved in and it took some bone with it and they've called it a broken jaw?!?! hysterics"
